New York's rocky transition from mechanical voting machines to paper ballots read by optical scanners just got a little more difficult.

A legal scholar at New York University's Brennan Center for Justice said Thursday that he's spotted an error in the instructions sent out with the city's sample ballot.

The instructions tell voters to fill in the oval above the name of the candidate they want to vote for.

"Unfortunately, if they want to vote for a candidate, they should be filling in the oval just below the candidate's name, not above it," said Lawrence Norden, senior counsel at the center.
