Battle Lines Drawn In NY Gay Marriage Suit

Lawyers for five gay and lesbian couples suing for the right to marry in New York State told an appeals court on Monday that New York City is wrong when it defends maintaining the status quo.

The city is appealing a February ruling by a lower court in Manhattan that said it was unconstitutional to deny same-sex couples the right to marry. (story)

"The city based its appeal on the assertion that it is important to support heterosexual procreation--but in so doing the government turns its back on children raised by same-sex couples who must go without the protections that come with civil marriage," said Susan Sommer, Senior Counsel at Lambda Legal and lead attorney on the case.
