of our constitutional rights to be state secrets, the Constitution is eviscerated. It no longer protects us. That amounts to establishing a dictatorship.
The Constitution is the only source of the sovereignty and power of the U.S. government. Therefore, the government cannot claim immunity based on the theory of sovereign immunity from our lawsuits for violations of the Constitution that grants it its sovereignty. The Constitution does not grant the government the authority to violate the very rights it grants us except under very narrow exceptions which have not existed since the Civil War.
Eric Holder should instruct his lawyers to refrain from making frivolous arguments just to delay the important court case regarding wiretapping. He needs to replace the attorneys who are wasting the resources of the Justice Department and the courts with these meritless arguments. It is a violation of an attorney's ethical duty to bring frivolous arguments such as the argument that violations of the Constitution and other laws by the government are protected from suit by sovereign immunity.
