1. It's that 'FAIR' part of 'Fair & Balanced' that confuses them - 'Fair Use' for news/commentary

But if YouTube wants to let them do it, then it is really YouTube's issue - but the video is already out, the damage is done and they are now crying like little babies to their lawyers because their video got royally slammed and buried by all the coverage. Talk about creating a mockery of oneself - they did it.
