Not to say that he may someday get indicted.... but I simply can't see how he could have been and then got a subpoena for the Libby case?

but following the story the past few days, Libby's attorneys are arguing that he was set up to take the fall for Rove. Who knows what threat or actions were taken up till now that encouraged individuals to talk. I am going to stay tuned for the next episode.

If it exists. Now we can guess that Rove doesn't have immunity, since a subpoena was necessary.(could be wrong about that--)
You see, Libby obstructed Fitz in his investigation of the leak. The obstruction case has to be cracked open and dealt with before the larger crime of the leak itself can be successfully prosecuted. Because Libby lied and obstructed, Fitz didn't have what he needed to serve that sealed indictment. Perhaps he will get a break during cross examination. Will Rove say something he shouldn't? Or will the snake slide away untouched?
We don't care. Because we don't want Rove. We want Cheney. And it is ever so much more possible that Rove will viciously let something slip about Dick than he ever would about himself or the Chimp. I think Cheney is going under the bus, and soon.

How many knew Ari had immunity? I would venture to guess that as we're not on FitzG.'s speed dial there may be more that happened behind the scenes that we don't know and all the guessing in the world won't provide an answer until he does.
