"Even if the bill is passed this weekend, the ban on gays in the military does not end immediately, and military officials and activists continue to warn that gay men and lesbians serving in uniform should not make public declarations of their sexual orientation until the law is officially repealed.

According to the legislation, the issue would rest entirely with Obama and top military leaders, who must inform Congress in writing that they have reviewed the findings of a Pentagon study regarding an end to ban and that the Defense Department has drafted the policies and regulations necessary to end the law. Those changes must not impact troop readiness, cohesion or military recruitment and retention, according to the law.

Once the written notice is submitted, 60 days must elapse before "don't ask, don't tell" is officially repealed. During the two-month window, lawmakers are likely to hold hearings to review the Pentagon's policies and procedures for accepting openly gay and lesbian troops, according to congressional aides familiar with the matter.

The White House and the Pentagon have not discussed a specific timetable for ending the ban, but Gates said this month that he expects Obama "will be watching very carefully to ensure that we don't dawdle or slow-roll on this.''


Close military observers anticipate that the ease of ending the ban will vary widely among the different military branches and that the Pentagon may stagger implementation of the change across the military branches."

6. President signs bill next week. POTUS, SOD and CJCS certify. 60 days -> implementation.

Most of the policies and procedures are already in process, certification is only required by the three key people (POTUS, SOD, CJCS) and a simple message to Congress implements the law at the service level.

(All three of the officials required for certification have already indicated an intention to do so. Pres Obama is a given, and Sec Gates and Adm Mullins, specifically, have made statements to the point today, after the vote.)

I think some of the hyperbole about possible "loopholes" in implementation is just that. Hyperbole.

because they would require approval at the top levels. Since all the people who need to sign off are already in favor of repeal (Obama, Gates, Mullen), it can be seen to that yesterday was the last time a United States soldier was ever discharged from service for being gay--none of them will sign off on a discharge under a dead law.

(aside) I was touched by Sen. Collins' "thank you" to gay and lesbian military personnel in her statement. It was a nice, personal comment from a (R) in speaking about the political context of the vote.

16. The JAGs I've talked to over the years have said the policy rarely gets enforced like it used to.

Nonetheless, this disgusting policy is now relegated to the dustbin of history.

Collins showed a lot of leadership with this issue and should be commended for her tenacity and working 'in good faith' with the Democrats.
