DiscountVouchersThe Conservative-led government has received an embarrassing blow to its desperate attempt to impose limitations to immigration into the UK when the High Court declared that it was illegal to impose an interim cap on the number of people who can enter the UK as skilled or highly skilled workers from non-European Union countries.
Those who were affected by the limitations imposed are now free to make a new application for work visas to the UK. The High Court held that it was not lawful for the government to impose such limitations as the limitations were introduced without any parliamentary discussion or approval.
The new immigration measures were introduced by Theresa May, the UK Home Secretary, in order to stop a rush of visa applications that were expected to come just before a new fixed annual cap comes into effect from April next year. The judges of the High Court handed down a judgement that said that Ms May had illegally tried to step around any form of parliamentary scrutiny on this proposal, and as such, this immigration cap was not a valid law.
Lord Justice Sullivan said that there was absolutely no doubt that the Home Secretary was trying to side-step the parliamentary scrutiny provisions that were implemented in the Immigration Act of 1971. Lord Justice Sullivan went on to say that as a result of this behaviour, Ms May’s actions therefore resulted in an unlawful cap being imposed.
