Suit over ID rules for air passengers may be broadened

By Paul Elias
ASSOCIATED PRESS

December 9, 2005

SAN FRANCISCO – A wealthy Libertarian who is fighting a requirement that airline passengers show identification before traveling asked a federal appeals court yesterday to broaden the scope of his battle to cover other forms of commercial transportation.

The request to expand John Gilmore's case was made during arguments before the 9th U.S. Circuit Court of Appeals, which is considering his argument that identification demands at airports are illegal searches that violate his right to travel freely throughout the United States.

A lower court judge had earlier rejected Gilmore's case and U.S. government lawyers have refused to confirm or deny that a federal law or regulation requiring IDs at airports even exists. Government lawyers say they're barred from disclosing the existence of security-related regulations.
