Slaying suspect still on ballot

Scott Winfield Davis is doing most everything he can to drop out of the governor's race. But despite his efforts, a state official says Davis' name will still grace the October ballot.

Davis announced his withdrawal late Tuesday, after the Mercury News learned that the Palo Alto resident remains the "top suspect" in an unsolved slaying-arson in Atlanta, even though charges against him were dropped years ago.

The erstwhile candidate -- who said he's innocent -- has shuttered his campaign Web site. And he has e-mailed the Mercury News, saying he's departing for a brief vacation and will not speak to the media.
