... he's disobeying the law. Forget the Oath as some here want to debate the meaning of it.
At a minimum he's violating several Articles of the UCMJ. A quick glance at them shows that at a minimum he's looking at possible prosecution under any of the following:
Article 87 Missing Movement Article 90 Assaulting or willfully disobeying superior commissioned officer Article 92 Failure to obey order or regulation Article 94 Mutiny and sedition
The UCMJ is rather clear cut and not nearly as nuanced as civilian law. If he's going to protest he should at least keep it very quiet and to himself. If 50 guys get up and leave that ship because of him he's looking at Article 94 which is going to turn out badly for him.
And before any of you suggest I go I'll tell you I already went and was in the military from 89 through 94 and spent a good deal of that time on the sand over in the Middle East.
