"In Pennsylvania, several murderers have had death sentences reversed because prosecutors used the Bible as support for the death penalty, said John Blume, a Cornell Law School professor. In that state, prosecutors are not allowed to use phrases such as "an eye for an eye" to endorse the death penalty.

Blume knows of about 100 capital cases that were challenged between 1985 and 2000 because of a prosecutor's religious remarks.

Yet these cases are not happening in Texas, where lawyers can Bible-thump to high heaven.

Blume believes that lawyers shouldn't utter "an eye for an eye," because it endorses Old Testament religious mandates, which are in conflict with federal laws stating the death penalty is never mandatory."
