To be called a pirate (meaning a bandit at sea, not someone who makes illegal copies of software, etc.) a person has to commit a violent crime - Robbery or kidnapping at the very least. Use of force or threat of use of force to steal stuff. They are by definition a threat to life and limb.

It's always OK with me to use deadly force against a robber or kidnapper. If you kidnap or rob someone, you have forfeited your right to live.
