LETTER: Senators Ask Gonzales If He'd Like to Revise Previous Testimony on Wiretap Program in Light of Contradicting Comey Testimony

Senators Schumer, Feingold, Kennedy and Durbin are curious as to why it seems that Alberto Gonzalez lied about whether or not their was concern in the Dept. of Justice over the legality of Bush's domestic wiretap programming run out of NSA.

Gonzales testified in February of 2006 that there had been no such concerns, but the startling testimony of former Dep. Attorney General James Comey yesterday (video here) tells quite a different story, including a late-night trip by Gonzales and WH Chief of Staff Andrew Card to then-AG John Ashcroft's hospital room in hopes of getting his approval after Comey would not sign off the program. To his credit, Aschroft refused as well. Even after the White House --- apparently Bush himself --- called to inform him that Gonzales and Card were heading over.

The Senators sent the following letter today to Gonzales, reminding him of the apparent huge contradictions in his testimony as compared to Comey's, and to ask him for a "prompt response to the following question: In light of Mr. Comey’s testimony yesterday, do you stand by your 2006 Senate and House testimony, or do you wish to revise it?"

12. Impeachable offenses...
1. Running an illegal domestic spying program that the entire top tier of the Dept. of Justice AND the head of the FBI were threatening to resign over. Implementing the program without a Dept. of Justice sign-off on its legality.

2. Attempting to get a critically ill, heavily drugged AG (Ashcroft), who had signed his authority over to James Comey while he was ill, to change his mind and give an unauthorized, and dubiously legal, signature to the illegal spying program, in order to get around the Acting AG Comey.

3. Lying to Congress about it.

3. Firing/hiring US Attorneys based on political criteria that included their willingness/unwillingness to bring "voter fraud" cases without any evidence (or with scant evidence), to interfere with, and prevent, prosecution of Republican corruption, and to promote prosecution of Democrats, to influence elections.

4. Lying to Congress about it.

5. Gross malfeasance in the administration of the Dept. of Justice.

6. As White House counsel, promoting illegal and unconstitutional actions by the President of the U.S. and other officers, including the torturing of prisoners and the powers of a monarch--the "unitary executive"--that violate the foundations of our democracy.

7. Also as White House counsel, providing the targets of a DoJ criminal investigation, in the case of the outing of a CIA agent and a CIA WMD counter-proliferation network, with a 12 hour heads up to shred documents and burn hard drives.

8. Depending on just who the illegal spying program was targeting, there may be other causes of action. One suspicion is that they were spying of John Ashcroft and James Comey in their private discussions at the DoJ of the illegal spying program, and that this is what precipitated AG Gonzales' and Bush aid Andrew Card's rushed late-night visit to John Ashcroft's ICU bed. Other suspicions: the political opposition in the leadup to the 2004 election. (Visit to Ashcroft's hospital bed was in March 2004.)

to signing off on the program.

I mean, Ashcroft signed off on it at least a dozen times before he/Comey said no (in response, presumably, to a new analysis inside the DOJ). Did the WH resubmit the program, having fixed the concerns, or just did it just scrap DOJ 'authorization'?
