Defamation suit brought by man who made Obama YouTube video is dismissed (DU wins case)

Public Citizen scored a victory today (2/10) when a federal judge dismissed a defamation suit brought by Minnesota resident Lawrence Sinclair against three people who criticized him anonymously on the Internet.

Public Citizen represents one of the three defendants and a blog that was subpoenaed to identify Public Citizen's client. The defamation suit was filed in the U.S. District Court for the District of Columbia.

Last year, during the presidential primaries, Sinclair posted a YouTube video in which he made outrageous claims against Barack Obama, arising from a supposed encounter at a Chicago nightclub in 1999 with the then-Illinois state senator.

In dismissing the suit, Judge John D. Bates found Sinclair's case did not show enough merit to identify the anonymous critics, who had posted about Sinclair on DemocraticUnderground.com and Digg.com.

"The right to speak freely and openly on matters of public importance - and to choose to do so anonymously - is a cherished right in this country," said Paul Alan Levy, the Public Citizen attorney who handled the case. "Courts have consistently ruled that there must be a compelling reason to take away someone's right to speak out anonymously on the Web. This case was no exception."

This case has been going on for about a year. Some of you may remember that Larry Sinclair had subpoenaed Democratic Underground to force us to disclose the identity of one of our members, mzmolly. We were determined to fight the subpoena, and were fortunate to receive free legal help from Paul Levy, an attorney at Public Citizen who specializes in Internet free-speech issues. I didn't know too much about the guy, but some blogs reveal quite a bit about both him and their own biases. Found this excerpt on one blog (http://lamecherry.blogspot.com/2008/08/political-prisoner-lawrence-sinclair.html) advertising dear Larry as a "political prisoner"...


"He was illegally detained like in a Turkish prison in DC, denied his medications like in a Russian gulag by US Marshals, lost in the system like in a Chinese prison in DC and has faced propaganda posted stories like a Nazi kangaroo court coming out of Delaware."

And this except is even better...

"The situation Mr. Sinclair has currently been placed in by the Democratic presidential ticket is they are forcing a disabled person with nerve damage to drive from Duluth, Minnesota to Delaware to be terrorized there in a court trial over a sealed indictment the Delaware Attorney General's Office will not respond to in direct violation of his Constitutional rights of Life, Liberty and the Pursuit of Happiness...."

I actually posted a Youtube video made by another person with a recap of the content. I was sued for passing along the claims of another party. Where the claims originated, who knows? But after observing scam artists in action for a while now, I have my suspicions. ;)

I actually posted a counter video (produced by another defendant in the case) asserting that he was elsewhere during the original incident in question. The Judge ruled that the information posted was already on the internet, so essentially that's partly why there was not a sufficient case.

Hope that made a lick of sense?

This is a great story.
I think it worth noting that we can be grateful a Judge at the District Court level recognizes the rule of law to deny/dismiss.
Who knows what the USSC and its current make up would have ruled? My guess is less fairly.
Also, Joan Claybrook has stepped down (as of the end of January) as president of Public Citizen. Dr. Sidney Wolfe is serving as acting president. No matter who is finally picked to replace Claybrook it is going to be tough to fill the shoes of giants like Nader and her.
