California Wins Settlement From Omaha Voting (ES&S) Machine Company

Election Systems And Software Will Pay $3.2 Million
OMAHA, Neb. -- An Omaha voting machine manufacturer has agreed to pay California $3.2 million to settle a lawsuit claiming it sold unauthorized machines to San Francisco and four counties.

California Secretary of State Debra Bowen, who oversees elections, sued Omaha, Neb.-based Election Systems & Software Inc. in November 2007. She alleged the company sold 972 machines that the state had not tested and certified.

ES&S sold the AutoMark A200 machines to San Francisco and Colusa, Marin, Merced and Solano counties. Bowen, who announced the settlement Thursday, has said some were used in the November 2006 election.

The company claimed the machines made only minor changes from an earlier, certified model.

2. Oh, ES&S has cost us A LOT MORE than $3.2 million. Those fascist rat bastards
are worse than Diebold. They cost us our country in more ways than we can count.

3. Oh, those voting machines were 'tested and certified' alright
They just were not 'tested and certified' according to California law.

They were however setup to be manipulated in favor of Republicans.

4. They need to be prosecuted. I hope the Help America Vote bill included
a provision for paying the U.S. damages, too. And for personal civil and criminal liability of corporate officers if intent is present.

Do we want to go through the 2010 election holding our breath again?

We MUST demand that the feds pass stiff civil and criminal penalties for deliberately messing with voters, votes and/or voting, however done, whether by jamming phones, crashing websites, vote caging, intimidation, miscounting ballots, etc. etc. etc. And stiff civil penalties, maybe criminal too, for seriously negligent interference with same.

Write and call NOW, so that MAYBE Congress can finally get its act together and actually have a stiff bill in place by then.
