Two consecutive legislative session, followed by a vote.

By the time they get around to that, folks will be so used to Jane and Sarah, or Bob and Kyle, that it will be a non-issue.

This line in the story really made me LOL

"Kuhle argued that same-sex marriage could loosen the definition of marriage to include polygamy. Future generations might discard the institution if they come to believe that opposite-sex parents are not necessary, he argued." (been hearing that since the first POSSLQ back in the 60s.)
And then this old gem:
"Kuhle said state support for same-sex marriage would teach future generations that marriage is no longer about procreation despite thousands of years of history."

I am going to see several Repug legislators tomorrow. I will try to get their (laughable) opinion.

I don't normally listen to hate radio, but I couldn't resist.....I laughed and laughed....they are freaking out!!!!!!!!!!

I heard one say something about taking out Craig Paulson the Republican leader in the House....he is in my district....I sincerely hope they find a good evangelical to take Mr.Paulson down in the primary. I would love to see my district go Democrat!!

125. Marriage stopped being about procreation
when we didn't start enforcing the "bust out 3.5 kids or you'll be soilent green" rule.

Anyway if procreation is the goal then what does marriage have to do with fucking? Believe me there would be a LOT more kids if men didn't have to get married or be held accountable for fathering a child.

There would probably be EVEN MORE kids if men could bear children too. I know my partner and I keep trying.

The Iowa Supreme Court says the state's same-sex marriage ban violates the constitutional rights of gay and lesbian couples, making it the third state where gay marriage is legal.

In a unanimous ruling issued Friday, the court upheld a 2007 Polk County District Court judge's ruling that the law was unconstitutional.

The case stems from a 2005 lawsuit filed by Lambda Legal, a New York-based gay rights organization. The group filed a lawsuit on behalf of six gay and lesbian Iowa couples who were denied marriage licenses.

DES MOINES, Iowa -- The Iowa Supreme Court announced its ruling in a landmark same-sex marriage case Friday morning.

The justices ruled unanimously in favor of six same-sex couples who sought to get marriage licenses, but were denied.

The 69 page ruling means same-sex couples in Iowa can now get married under state law. The ruling said that the Iowa statute limiting civil marriage to a union between a man and a woman violates the equal protection clause of the Iowa Constitution.

The decision strikes the language from Iowa Code section 595.2 limiting civil marriage to a man and a woman. It further directs that the remaining statutory language be interpreted and applied in a manner allowing gay and lesbian people full access to the institution of civil marriage.

43. Amendments in Iowa
The process in Iowa is an amendment has to get simple majoritys in two consecutive legislatures then it goes to a popular vote. The Dems control the legislature so it is not expected to be brought up in the remaining couple of weeks in this session. Therefore the very earliest it could be enacted would be 2012.

77. Im Massachusetts, the Legislature simply did not act on it after the high court decided
that gay marriage violated the state's Equal Protection Clause. After two sessions, it apparently became too late to reverse the Court's decision. (Not sure of the legal ins and outs.) No one in Massachusetts even talks about gay marriage anymore. It's a non-issue. Could not be happier.

the amendment process will take approximately 6 years, if not longer. Plus, the majority leaders - both Democrats - said no action will be taken, so the amendment process may take even longer. In 6-8 years will it even be an issue?

Steppingrazor: You're right, all they need to do is amend the Iowa constitution. BUT, that will take at least until 2011 because the process for actually changing the constitution in Iowa takes a long time. AND there are Dems controlling both state houses who will not let a constitutional amendment bill come up for a while. This could well stick for several years.

I was thinking - hey, Wisconsin, we are friggin neighbors, you think you are sophisticated and we are hicks like there is a big difference when you cross the Mississippi. What an idiot. I'd expect that from someone on the coasts but, geez, we are essentially the same area.

Obviously, too many Iowa jokes have been focused on Minnesota. They need to be switched to Wisconsin. ;)

Don't know how many, but California's losing a lot of us that are getting disgusted with the problems of housing, cost of living, and in some areas attitudes that allow for such BS like prop 8 to pass...

Proud to have been a college grad and resident of Iowa for so many earlier years. Iowans may be conservative in some parts of the states, but they really do think about the big picture in many areas. As a caucus state, they train themselves to talk about things before they vote on them!

If you are in the health care industry, and are looking for a place friendly to gays, and where the per-capita level of education is higher than most places, Iowa City would be a great place to go to now, if you don't mind the snowy weather (and now it would appear some potential for floods) for parts of the year... It already has one of the highest per-capita gay populations, per-capita population with college degrees, and its university hospital for many years lead the country in the number of beds it had in it. That might have changed since then.

And for a while, it's concert hall, Hancher Auditorium, was second only to the Met in terms of its accoustics, since it shared a lot of the design that building had.

Aside from the weather I loved the place.

I moved from there a month ago. Too exp. up north. Back in Cristville! ha from one Mickey state to another.

I think a good 10% of people went in to the voting booth not knowing wth they were even voting for or against - and got confused. There's too many progressive in CA to have a 52% majority say they want to remove rights. Some maybe thought by saying no they were saying no to marriage rights, who knows, because as I age, I get slightly more befuddled when put in pressure situations, lol. Most people I ever met were very open-minded, of course I didn't visit small towns outside the major population zones, but even there, there's a good 35% of people that are hateful. Having grown up and lived there through my 20s, I would agree with you on the comment about big picture thinking. My take has always been that Iowans *tend* to vote with a more open mind than they live and conduct their own lives ("Sears clothing is fine. Don't wanna be puttin' on airs there, son."). However, when it comes to desserts, you'll always find some dandy has put marshmellows in the jello.

And that is an understatement. I'm pretty sure that even though state constitutions are all different other state supreme courts will take this into their consideration as legal precedent for their bans as well.

It is possible that in spite of the way things have looked we could be on the front end of an avalanche. That is what happened with civil rights for African Americans.

of the economic boost the floral, bakery, wedding planning and officiant industries are getting. I'm a wedding officiant myself and if NC weren't so damned backwards, I'd appreciate the economic boost. Weddings, period, have been off this year and those I've been doing have been downsized. If I had the right to marry my partner (which I'd dearly, dearly love) I'd equally love to be able to marry my GLBT brothers and sisters really and truly instead of just the church-union ceremony I can provide now.

I have this notion, y'know? How is it that it's okay for the fundies to bitch about same-sex marriage somehow being the state telling them how to practice their religion when no-one is telling them they have to marry same-sex couples, yet it's not okay for me to bitch that the state is ALREADY telling me how to practice MY religion by forbidding ME to marry same-sex couples?

IMHO, that makes both the state and the wackogelicals hypocrites. It seems to be adding hypocrisy to hypocrisy that even if my partner and I went to Massachusetts or Iowa to get married, neither NC nor the fed would recognize it anyway. So much for "full faith and credit".

For now, I refuse to be in a bad mood over that. I'm gonna celebrate the hell out of one more small victory in Iowa!

I haven't read the decision but if the decision says that marriage can't be denied to gay people because the constitution provides for "equal protection" then wouldn't an amendment to overturn the verdict require the repeal off "equal protection"?

the ones to overturn this, by approving a constitutional ban. It takes two consecutive legislative sessions (i.e., two years) to approve a constitutional amendment. And because key power players in the Iowa legislature (ruled by Dems) have stated they believe there are more important issues to spend their time on during this current session (jobless rate, flooding, etc.), it is doubtful there would be any action during the current session regarding a constitutional ban. Thus, it'd be at least three years before any constitutional amendment could be passed legislatively and subsequently handed over to voters at the ballot box.

last I read here earlier this week is that it was most likely that the California supremes were going to uphold Prop 8 and it was getting kicked to the legislature to resolve.

167. Who'd a thunk it? "Is this Heaven? "Nope. It's Iowa".
The times are a bit tough; money is gettin' more scarce around my household; and, my old pickup has over 160,000 miles on it. But, the old truck is still pretty sound. Sound enough that I believe it would make it from East Texas to Iowa and back. I'd kinda like to take a back roads trip up to that fine country; find a pleasant bed-and-breakfast; and, drop in to some small town cafes for a cup of coffee and visit with the local folks.

Fact is, I'd rather spend what little vacation money I have in a State where the legislators exercise uncommon good sense and decency toward the citizenry. Besides, there might just be a baseball game goin' on somewhere in that fair land on a beautiful summer night ~ a place where a fellow could munch on a hot dog and do a bit of reflectin' on earlier times. What a pleasant thought!

I'm mighty proud of Iowa and Iowans. The progressive stance of the State appeals to me. I hope to make my first visit this summer.

You must visit the Field of Dreams where the movie was filmed. Just so you know, northwest Iowa is VERY conservative, and I doubt this decision is going over well. Might want to avoid that part of the state. They are the home of our very own nutjob congressman Steve King.
