MN SENATE ELECTION JUDGES COUNT FINAL BALLOTS, FIND FRANKEN WINS!
Tally concludes finding 312 vote win for the Democrat, as Coleman prepares his final appeals
But does the Republican have a legal leg to stand on?...

Author and former radio talk show host Al Franken, the Democratic challenger for the U.S. Senate seat in Minnesota, will be the state's next U.S. Senator, according to a final tally by the bi-partisan three-judge panel overseeing challenger Norm Coleman's election contest against him.

This morning in St. Paul, officials from the Minnesota Secretary of State's office, under the in-court direction of the three-judge Election Contest panel in the former Senator's contest against Franken, tallied all remaining lawfully cast absentee-ballots that were not previously opened and counted. This was done on camera, in open court. The attorneys from both sides, along with the media, were all present.

The final tally of the remaining ballots was 198 votes for Franken, 111 votes for Coleman and 42 votes for "other." When this is combined with the initial 225 vote lead, certified by the bi-partisan State Canvassing Board in December, it adds up to a 312 vote Franken victory, arrived at by both a transparent, post-election hand-count late last year, and the painstaking care exercised by the three-judge panel.

Al Franken has now won the U.S. Senate seat, but do Coleman's promised appeal(s) stand a chance of winning? And will the Democrats in the U.S. Senate now assume their Constitutional right to dutifully seat the Senator from Minnesota?...

96. Exactly. Pawlenty's schtick is to play the moderate sane guy during campaigns.
Pawlenty is not going down with Coleman, especially while the calls for Coleman to give it up grow. He will find a way to sign it when the MN Supreme Court rules.

89. Do we really need a certificate?
Harry Reid has already said he would act after the MN courts made their decision (not just "the courts", so we don't have to wait for the SCOTUS).

So once the MN Supreme Court rules in Franken's favor (or declines to review), seems like Franken can be confirmed, certificate or no certificate.

Pawlenty, being a member in standing of the Insane Republican Party, will not sign to certify. It is not over. Imagine, all this after the presidential election and SCOTUS decision in 2,000.

131. Pawlenty is in a bit of a bind. Minnesotans do not care for bitter politics and that's what this
has become. The bitterest of ironies is that Pawlenty wanted to run for Senate against Wellstone, but Cheney said no and hand picked Coleman. Now Pawlenty is going to have to either suck it up and do the right thing for the State (which we expect), or cow tow to the party that has screwed him over whether it be for his aspirations for the Senate, or McCain choosing Palin over him for Veep. Now he's being screwed by Coleman again. Sucks to be Timmy.

It says in the Constitution that every state gets TWO reps in the Senate, so it's just plain unconstitutional to wait any longer.

I say if Coleman and the Repugs file more appeals, the citizens of MN should SUE the US government for under-representation and Pawlenty for obstruction....since the Senate can seat Frankin this evening if they want. All law suits will be dropped when Frankin is seated....of course. Except for the one where they sew Coleman for wasting the taxpayer's money and the government's time.

The laws in Illinois and the reasoning behind Burris being seated are completely different from what is happening in Minnesota, which legally will not allow a senator to be seated as long as their is legal action.

These are republicans that we are dealing with - they'll litigate it to death in hopes that somehow they'll pull it out. Fuck the people of Minnesota and the fact that they have just one person representing them in the senate (and that's in the minds of the republicans).

If they were smart, they'd let this go give the seat to Franken and then go after Klobacher when her election comes around in 2012.

That's as long as their is legal action in MINNESOTA (as detailed in the full article). The law is clear that no certification should be given while the election is still being challenged in MN's court systems, much less clear about whether a cert should be given while an contestant is going to the U.S. Supreme Court.

That's a big difference, and where the dispute will now fall for the moment.

BECAUSE Minnesota was so thorough in assessing circumstances/votes . . .

that the court would like say they're not looking at the evidence again --

and appeal would be over. Let's hope so!!!

for breaking repuke filibuster; thus, continuing this in the courts is enough for repukes to "win." This is really not about Coleman v. Franken - it's about keeping the Dems from that 60 voting bloc.

The Senate has the right to seat Franken no matter what the Court says.

If they )the Court) rule in Coleman's favor and the Senate chooses to seat Franken anyway, there is little the Court can do and it could have the effect of weakening the position of the Supreme Court because they'd look impotent.

...the short-sightedness of the Republican Party in this area. By making a huge stink with Franken, it may have also cost them the governorship of Minnesota.

If he signs, he will lose some Republican backing. If he doesn't he's going to be accused of obstructionism, petty politics, etc.

Or it could have been an accident but I still wonder how it was that the FBI and NTSB, both based in the Twin Cities arrived hours apart at the site of Paul Wellstones plane crash.

The FBI, breaking the laws of physics, arrived at the crash site within 1/2 an hour while the NTSB took the normal 3.5 hours to drive 3.5 hours. The FBI took "control" of the site (which they are do not have the authority to do ) and banned all local cops from the area for the next 3 hours and who knows what they did in that time.

Was Paul Wellstone, arguably the most effective and powerful progressive in the Senate killed? I can't say, but something wasn't kosher about the timing. How could the FBI arrive 3 hours early in a 3.5 hour drive unless they were dispatched ahead of time?

So if you combine that little tidbit with SH's revelation that Darth Cheney maintained a hit squad, then yah, those thugs will try anything.

51. I believe one of the things the FBI did at the crash site
(assuming it was the FBI and not private Bushco operatives) was chase the local fire department away and let the wreckage burn. I could be remembering that incorrectly, and so you might want to check it out - I'm at work and don't have time to do so right now.

speak out against going to war on the floor of the Senate. You don't have to be a conspiracy theorist to connect the dots. After 9/11 the U.S. became a virtual military dictatorship.

Here's what was said in the Senate on December 15, 2000 as this law, a.k.a. the "Enron Loophole" was passed. First of two comments by Phil Gramm, its covert sponsor. Second by Paul Wellstone. Wellstone's remarks show that THERE WAS NO VOTE ON THIS AT ALL... IT WAS "AUTOMATICALLY PASSED" BY THE REPUBLICAN MAJORITY LEADERS. It was a last-minute amendment to an 11,000 page Federal budget. ("Mr. President" is formal language which refers to President of the Senate.)


Mr. GRAMM:
"Mr. President, today I am proud to add my voice in support of the Commodity Futures Modernization Act of 2000. This legislation represents the end product of work that began in S. 2697, which Senator LUGAR and I introduced on June 8. The Commodity Futures Modernization Act of 2000 completes the work of last year's financial services modernization law, bringing our financial regulation in line with the rapid pace of developments in the global marketplace. The Commodity Futures Modernization Act of 2000 will now allow new and important financial products -- single stock futures -- to be sold in America. It protects financial institutions from over-regulation, and provides legal certainty for the $60 trillion market in swaps...
Mr. President, enactment of the Commodity Futures Modernization Act of 2000 will be noted as a major achievement by the 106th Congress. Taken together with the Gramm-Leach-Bliley Act, the work of this Congress will be seen as a watershed, where we turned away from the outmoded, Depression-era approach to financial regulation and adopted a framework that will position our financial services industries to be world leaders into the new century."



Mr. WELLSTONE:
"Mr. President I want to voice my strong objection to the process by which this legislation is being passed by the Senate. The Omnibus Appropriations conference report -- containing numerous other pieces of unrelated legislation -- is being passed by the Senate tonight under a consent agreement that was entered suddenly by the Majority Leader without the normal notification process. We should have had a recorded vote. Since I first came to the Senate 9 years ago I have felt that it does the Senate no credit to pass such significant budgetary legislation -- literally hundreds of billions of dollars -- without a recorded vote. We cannot be held accountable as Senators to our constituents when such bills are passed in this manner. I want to make it clear; I oppose this legislation and I would like the RECORD to show that I would have voted "no" had there been a recorded vote."

97. Wow, first it was 2 hours, and now it's down to 1/2 an hour
I keep waiting for the foil hatters to say they arrived a week before. Not even Jim Fetzer, who originated all that nonsense (and never met a conspiracy theory he didn't like), didn't claim 1/2 hour.

The first FBI agents to arrive came from Duluth, not the Twin Cities. There were agents from Minneapolis, but they arrived much later. They arrived arround noon, but nobody knows exactly when. It could have been 12:30 or later, but in the absense of an official record I suppose Fetzer is free to make up his own times and he surely did. At any rate at the distance the Duluth officers had to travel could have been covered in 50 minutes with lights and sirens (which they did employ). None of the FBI officers had access to the actual crash site until hours afterwards because the fires were still burning. Fire and police were the first on the scene.

If you do a bit of research on the pilot and the 1st officer, they were truly a piece of work. Both of them were and accident waiting to happen and it did. So I guess people like Jim Fetzer can sell a lot of books, but that doesn't mean there's any reality in the foil hatters' claims.

Recently I was reading that the CIA was funneling funds to right wing members of
Congress -- way far back -- two mentioned were Sen. Strom Thurmond and Rep. Gerald Ford!

Then throw in electronic voting machines which began to come in during the mid-late-1960's
-- right around the time the Voting Rights Act was passed -- and I think every Republican
"win" since then is in question. Right back to Nixon/Humphrey!

What really worked for them is the many who dropped out of voting because of the obvious
fraud -- and the way that the Republican "wins" piled up to frustrate Democratic voters
and make them feel powerless.

30. They had already counted them, but...
...There were a few more that both Franken and Coleman had found were inappropriately rejected before being counted.

The few ballots that the 3-judge panel found were lawfully cast, but not counted, were tallied today.

Coleman argued some 5,000 or so of them, originally, should have been counted, but it turns out the bulk of them were not lawfully cast (though that didn't stop Coleman's team from arguing they should be counted anyway!)

133. Listening to MN public radio yesterday their experts said the MN SC is required
to hear the case and that in ruling for Franken they would order that he be certified the winner. Pawlenty would then have no choice and would have to follow their order and that gives him the out to do it. They also said the MN SC is very judicial and not partisan. The Chief Justice, Alan Page, is after all the one who appointed the 3 judge panel who heard this case--1 Democrat, 1 Republican and 1 independent and all of their rulings have been unanimous.

So there is 1 more state challenge to go. Unfortunately, the Senate sort of set the rules to be seated with Burris. So to be consistent, they will most likely require a certificate signed by the Gov and the SOS before they will seat him. Blago strikes again.
