I don't think that Joe & Jane Averageamerican have a whole lot of empathy for some terrorist who has been tortured. Some of those guys--Zabaydah, Khalid Sheik Mohammed--are genuine bad guys. Put them on the witness stand (and you have to--facing your accuser is in the Constitution) and you will give them a platform. A smart defense attorney could & WOULD bait the witnesses into an anti-American rant. It's happened before. Meanwhile, Joe & Jane Averageamerican are watching this from the comfort of their living rooms and getting madder and madder that OUR government wants to punish people who are giving the bad guys a little of what they've got coming to them. The Obama administration will totally own whatever happens in that courtroom. The public could very easily turn against them.

Just my two cents.

See the whole thing about trials is that until you have them, you don't KNOW whether the suspect WAS a terrorist or not. That is precisely WHY everyone with half a brain wants trials for these detainees. Without trials, you can't know AT ALL, whether the suspect is a terrorist or just some schlub.

And without some kind of due process, the US is no better than any banana republic when it punishes people (by say holding them indefinitely and torturing them) with no kind of charges.

If our ignorant countrymen and women need to be educated about how wrong BushCo was about everything, I'd be happy to help. You can start by reading the archives.

What they don't know hasn't hurt them.... yet. However, thanks go Dick and Dumbya, we are more at risk now than ever - and it's not just "Terra-ists" either.
