Greeley judge unhappy with pot-themed sub shop
Source: The Denver Post

GREELEY — Cheba Hut owner Scott Jennings enjoys serving tasty, toasty sandwiches with a side order of pot humor.

But it was all lost on a Greeley municipal judge who this month denied Jennings' request for a liquor license for his establishment.

Judge Robert Frick, Greeley's lone liquor-license authority, ruled that serving booze at the Cheba Hut would not fit in well with the neighborhood adjacent to the University of Northern Colorado campus.

Jennings, who was asked by Frick at the licensing hearing whether he is a frequent pot smoker, has since "lawyered up" and is asking a District Court judge to overturn Frick's ruling.

"It was a completely bogus decision," said Jennings, who started the Cheba Hut franchise 11 years ago near the Arizona State University campus.

This was a completely bogus decision. The business is a franchise that's operated for over a decade near other college campuses with no incidents reported. This court decision was based entirely on the judge's own biased prejudices, not on any kind of rule of law.

2. Exactly what does smoking pot have to do with serving alcohol?

10. It's the judge who made that connection.
The hilarious part is that in Colorado, probably at least 40% of any given town's population smokes pot, and especially in college towns, on college campuses. So it's funny that this judge thinks by banning alcohol in a legal--albeit pot-themed--restaurant is somehow going to deter behavior that's already ongoing.

3. Especially in Colorado....
But enough with the reactionist RW judges, already. If they want to live like TaliBaptists, they need to find a way to do so without infringing on everyone else.

4. Actually, Cheba Hut WOULD fit in with the neighborhood
There's a heckuva lot of toking that takes place at Northern Colorado...

8. Cheba Hut is one of the few things I miss about living in Tempe
I used to work near the original location near ASU and they had some amazing sandwiches. Loved the hippies that worked there too--somehow they never got my order wrong, which defies logic. Great service and really nice people.

Keep in mind the company also does a lot of activism regarding legalization, which is probably the real reason for this decision. Liquor license = more profits = more money to fight draconian drug laws. And we can't have that.

9. Cheba Hut
Just opened across the street from UNM in Albuquerque . . . seems that CH fits in very well in the college environment. I too used to live in Tempe and dreamed of opening my own CH . . . but thankfully someone else did.

12. It's Part of The Backlash
(IMHO) against Democratic wins in November.
Those RW loons w/o any power go on shooting sprees.
Those with job related power, like this judge, teachers, cops, etc
can lash out in seemingly "legal" ways against people
they think might be Democrats. Store owners might even refuse
service to Democrats as one of our own DU'ers did a while back
to a *bush supporter in a town just north of San Fransisco.
