How Garrido got out the first time
Source: SFGate

When Phillip Craig Garrido was sentenced to 50 years in prison in 1977 for kidnapping a South Lake Tahoe woman so he could rape her in a Reno storage unit, the prosecutor who put him away figured that was one sexual predator who was gone for good.

Under sentencing guidelines now in place, Garrido would have been behind bars for more than two decades - and wouldn't have been free in 1991 when 11-year-old Jaycee Dugard was snatched off the street in South Lake Tahoe, not far from where Garrido kidnapped Katie Callaway Hall in 1976.

But under 1970s-era sentencing laws, Garrido was eligible for federal parole after just 10 years - and he was set free in 1988.

"It was a horrendous crime," said Leland Lufty, the former federal prosecutor in Reno who won the 1977 conviction against Garrido. "We had a tough judge. As far as we were concerned, he was locked up forever.

"How could they do that?" Lufty asked. "Look at the record, look at what the guy did - this case was premeditated as it could be."

He's a perfect example of someone who should be locked up forever.

9. Don't kid yourself. If you think they are only going to
release "over 60 drug offenders" I've got a bridge for ya.

14. In this case he had a 50 year sentence on a federal kidnapping rap
The US government should have sufficient funds to keep him in in a federal prison for most of that sentence.

2. Garrido and victim
I am not surprised at all judging from my own experience in Mammoth Lakes, California. To make a long story short in the case of sexual abuse to a child by the live in boyfriend of the victim's mom the CPS did nothing... In spite of declarations and a recording of information by a friend of the child to whom the latter had told her revealing information, the agency did nothing. As a member of the County Mental Health Advisory Board I was advocating and walking (helping through the system ) a family and a friend of the family. I had also obtained the services of a bilingual therapist specialized in abuse cases, specially with children. The authorities refused. (I had taken in Spanish and translated to English declarations of family members and a friend who had revealing information.) The Director of the Agency that over saw the CPS cited me and the friend to a meeting where we thought that the matter was finally going to be taken care of. Instead the Director accused us of fabricating information and menaced us to call the police to arrest us right there, although it was just an intimidating tactic. It was very bizarre to say the list. Under threat of my being arrested, he obliged me to surrender (without a warrant or court order) the tape with the declaration of the victim's friend. He promised to give me a statement dclaring that he was obliging me to surrender the tape under threat. He actually did not. Even afterwards when the victim told the friend and her mom that the devil was getting into her room at night, the authorities refused to interview the mom of the friend. So, it doesn't surprise me the inefficiency and disregard for victims by the California CPS and other law enforcement agencies. Thinking back now, I should have not given the tape and be arrested and not give in to the threat... Complaints to the Grand Jury of the Mono County only white washed the whole thing. It is disgusting!!! The frigging law protecting children do not have enough teeth. Law enforcement officers should be obliged by law to be thorough and more aggresive in these cases of abuse and on the contrary have charges files against them if not complying.

6. You're kidding, right?
smoking pot is worse than raping a kid, according to jail sentences?

Wow. Now I see why so many US americans are so fucked up they can't think straight. Almost sounds as bizarre as African men raping infants 'cause they think it will cure their HIV/AIDS.
So much for a civilised country...

Edited on Wed Sep-02-09 11:12 PM by defendandprotect
like 25 years --

I've kind of lost track of where we are now but this is insane America!

All you have to do is frighten us a bit about a drug or "terrarists" and we'll

flush democracy down the drain for you!!

Don't know why the world hasn't woken up earlier but at least other nations are

signaling they're fed up with our "Drug War" BS . . . as far as I can see it's been

used to co-opt and invade other nations!

American imperialism -- sickening!

13. After a year in prison for rape, he claimed he was rehabilitated.
http://www.nydailynews.com/news/national/2009/09/01/2009-09-01_jailed_kidnap_monster_phillip_garridos_chilling_letter_asked_judge_to_give_him_a.html

At least back then he waited a year. This time he claimed he turned his life around right off the bat.
Can't wait to hear what a heartwarming story this will turn out to be.

19. Saw the woman he raped on Larry King the other night . . stopped to watch some of it --
Evidently he would have had to file as a sex offender???

Odd -- no one checking up on him?

And when someone reported a few years ago that there seemed to be strange

things going on in his backyard . . . that wasn't considered????

Pardon me, but as the right wing patriarchs rise, the stink of created violence

and sexual perversion rises with them!!

turn them loose. They are going to turn loose god knows how many soon in California.

PLEASE stop perpetuating this myth? Criminee! They're not releasing rapists and murderers. They're releasing non-violent offenders. What the hell has happened to DU? People used to actually do research before posting.

12. And never mind that while he is on parole, he is out and about
with these girls. A lot of his neighbors had seen him and his daughters. Yet his parole agent had no clue he had children. How about talking to his neighbors? Is that too much to ask?

15. Parolees
Read my post about my experience in Mammoth Lkes, California with the CPS ... the Director menaced to arrest me for following up on a child sexual abuse complaint where the agency did not take action. What do you expect with that kind of "law enforcers?":grr:

21. It seems clear to me that violence and sexual perverion is being created . . .
Edited on Wed Sep-02-09 11:18 PM by defendandprotect
and has been being created purposefully over the last four decades and more to

frighten the hell out of the public -- to traumatize them -- and to get them to

leave everything in the hands of the law enforcers! Little things like the fake

War on Drugs which has been terrorizing everyone!

We've sold democracy away for the illusion of safety -- and all the while much of

this IMO is created by the right wing perverts.

PS: I missed your post -- do you have a link to it?
