ST. PETERSBURG, Fla. -- Authorities say a Florida man is accused of stabbing another man in the neck after learning he was Muslim during a discussion about religion.

According to an arrest affidavit, the man who was stabbed told 52-year-old Bradley Kent Strott that he was Muslim while the two talked on Saturday. Investigators say Strott then grabbed the man by his shirt and stabbed him with a pocket knife.

The man who was stabbed was treated for his wound, though details about his condition were not available.

Strott was charged with aggravated battery. He was released Saturday evening on $15,000 bond.

ST. PETERSBURG – A man charged with stabbing a Muslim man in the neck over his religion was released from jail Saturday night.

Bradley Kent Strott, 52, and Samad Ebadi, 57, were talking about Islam at a tavern Friday night when Ebadi said he was a Muslim, a deputy's report states.

Strott turned angry, grabbed Ebadi by his shirt and stabbed him with a pocket knife, saying later that "Muslims are the root of the problem."

Deputies arrested Strott at Marsha's Wayside Inn, a tavern on 54th Avenue N next to Ebadi's convenience store, Sam's Food Market. He was charged with a hate crime of aggravated battery and booked into the Pinellas County Jail. He was released Saturday night after posting a $15,000 bond.

42. The problem is that you have to prove intent.

With aggravated battery, the prosecutor merely has to prove that this guy intended to harm the victim because of his hatred.

If he's charged with attempted murder, the prosecutor has to prove that he wanted to kill him, and not simply hurt him. It's a higher bar to reach.

If the prosecutor charges him with attempted murder and is unable to prove that he was trying to commit murder the guy could walk...even if the prosecutor can successfully prove that he intended (and did) harm the guy.

A prosecutor can PROVE intent to harm with a hate crimes enhancement, so he's playing it safe.

Don't get me wrong, I'm not saying he deserved it or anything like that, but what the hell was he thinking, going into a white trash biker bar like that and expecting NOT to be assaulted when discussing religion?
