Casey Anthony Ordered Back To Florida To Serve Check Fraud Probation
Source: Huffington Post

ORLANDO, Fla. -- Casey Anthony must return to Orlando within two weeks to serve a year's probation for check fraud, a Florida judge ruled Friday.

Judge Belvin Perry said that Anthony must follow a probation order issued by another judge and report to an Orange County probation officer no later than Aug. 26 at noon, although she could report earlier.

The other judge had ordered Anthony to report to Florida last week for her one-year probation. But that judge later recused himself and turned the case over to Perry, who presided over the murder trial that ended last month with Anthony's acquittal.

Anthony's attorneys had argued that she served her probation while in jail awaiting trial in her murder case and requiring her to do so again would be double jeopardy. They also argued that her life would be in danger if her location were known, given that she has received death threats.

Why do I get the feeling that O.J.... I mean Casey will be back in jail sooner or later.

2. She shouldn't have to serve probation on her theft charges?
Because she wasn't found guilty of neglecting and/or killing her kid - so wipe the whole slate clean?

Wow.

14. Incorrectomundo. Probation begins after incarceration.
She was held on one charge, now its time for probation on the other charges. You know, the ones that weren't acquitted or dismissed.

Do the crime, do the time.

27. Not the same
Parole is intended to work with a convict after their release so that it is ensured that they are entering society without continuing to perform their criminal acts.

Doubtful that she would have had the opportunity to steal credit cards and checkbooks and go on shopping sprees while in lockup.

Good on Florida for sticking to the law on this.

served while she was incarcerated. She did her time and her probation. Time to let it go.

38. Yup. The state of Florida let her
serve her probation in jail because they thought she would never get out. Now they lost so they want to change the rules. It doesn't work that way. It's time to let it go. How much more is it going to cost the state to have such a high profile person on probation for the next year? None of the judges have the sand to rule otherwise because they are afraid of the costs to them personally and politically. If I were here attorneys I'd appeal this all the way to the Supremes. I'm sure they are looking at their options.
Having said that, I'm no fan of Casey A. I just don't like the precedent set by this probation ruling.

didn't tell the police for a month after her toddler died, at which point the trail to however she had died had gone cold.

And the "poor girl" admitted to not calling 911 when she found her toddler drowned in a pool. What loving parent wouldn't have done that? At the very least, this "poor girl" should have been found guilty of negligence in the death.

20. Under our judicial system, one is innocent until proven guilty. She was not
guilty except for lying. She served her time for that. Now, this issue is with stealing money from her friend. I'm not sure why Judge Perry would want to have this girl put back into the Orlando area? He knows how the media riled up this case and tried it on tv thru speculation and finding anyone who would speak against her.

presuure of public opinion. The state of Florida said she served her probation while she was in jail. They never figured that she would be sprung.

35. Under our judicial system, one is only "presumed" innocent until
found guilty. BIG difference. Casey was found "not guilty" by that jury, she was NOT found innocent!
BIG difference.

Under our judicial system one is "not" innocent until proven guilty, one is only "presumed" innocent until proven guilty.

You need to understand our judicial system better.

6. Vindictive lot, aren't they?
If the prosecutor had done the job properly in the first place, a conviction might have been obtained. But now, because of a botched prosecution, the state has decided that the accused hasn't suffered enough for what "everyone knows" she did (but they just couldn't quite prove). I don't hold any brief one way or the other for Ms. Anthony, but this looks awfully petty on the part of Judge Perry.

She had this probation pending on a previous fraudulent check charge. One doesn't serve out probation while jailed for another charge. If anyone is being ridiculous it is those trying to make a victim out of Ms. Anthony. :eyes:

45. The state of Florida put it in writing that she has
in fact served her probation while incarcerated. Funny how the media has sparsely reported that fact. The state hedged their bets with the prosecution and the probation. They never dreamed she would walk. They lost. Of course there is going be a political cost to some of those involved in that decision making process. But it's time to cut their losses and move on. Dragging it out is only going to make it worse for all of them.

15. How so? This has nothing to do with Caylee
These are unrelated theft charges where she stole money, credit cards and checkbooks from her grandfather, mother and a friend and went shopping.

She was found guilty of these charges while in prison. Now shes out, and her sentence included probation, which she must now serve.

Don't conflate the two.

48. She already had a letter from the DOC; probation was over!
The judge overruled that letter. The Florida folks screwed up that case too.

I may be wrong, but I think they want her in town in case she gets a pile of money for a book or movie (she already got $200,000 from ABC). Then they want to go after the court costs. If she's completely free, even a judgement for those costs would be hard to collect.

They also want to catch her "jaywalking" while on probation so they can punish her.

It will cost lots more after the appeal of the probation, and then protecting her than it's worth. I know others in Fl who have a first conviction for check fraud, and they would rarely enforce such a probation.

She can apply, even while on probation, to leave the county. With all the violent criminals for the overworked probation office, they'd usually just tell a check-writer to call in on the phone to verify they are behaving and no more...

I don't think it is a pressing concern that she serves her probation immediately. I think it is a pressing concern that the criminal justice system be concerned for her safety, given she was found not guilty by a jury of her peers.

47. If you can't do the time, don't do the crime. Actions have consequences.
Sorry, but her sentencing for theft included a year of checking in with a PO to make sure she isn't continuing her repeated activities of ripping off the elderly (her grandfather), her mother and her friends.

Let her (or her now top dollar-on-demand) attorney hire body guards if they are so worried about her. She is a private citizen now.
