Third Circuit Repeats: FCC's Super Bowl Halftime Fine of CBS Was Out of Bounds

The Third Circuit Court of Appeals has reaffirmed its decision that the FCC's fine of CBS in the Janet Jackson Super Bowl reveal indecency decision was arbitrary and was a policy change that CBS stations were improperly penalized.

The court had already ruled the FCC decision on fleeting nudity was arbitrary and capricious on procedural grounds, but got the case back on remand from the Supreme Court after it ruled, in the Fox case, that the FCC's fleeting profanity policy enforcement was not arbitrary and capricious.

Plus, most of the kids who saw Janet's breast have grown up and gotten over it already, in a social perspective, unless they were raised in hyper-prudent fundamentalist families or broken homes. I have yet to hear of a sex crime case connected to the wardrobe malfunction! It is, however, debatable whether CBS planned the exposure in advance, as that would be a factor in whether a fine is warranted. I've got no problem with broadcast TV having content restrictions between 6AM-10PM.

But, in my old age (and mind you, when in the mood, I'm all about the sleaze...and when I get
cut off on the freeway, I will swear like a trucker) I think it ALL needs to be cleaned up.

It seems that there is so much that is over or near-over the top. I find nothing wrong with those
"dirty words" being avoided and the "near" nudity needs to be cleaned up as well.

If you want porn...then go buy it or rent it or find a nice "booth" someplace...or buy magazines...or
internet content...but since I can't buy my cable content ala cart, then I don't expect to see the dirty-deed in the middle of the day.

Yup! Call me a flip-flopper or hypocrite...but there is a fine line and the producers/providers just
keep creeping toward total full out obscene language and porn.

2. A glance of a breast will harm my kids, but untold violence is ok ????

My son and daughter happened to see Janet's boob (I was out of the room so missed it), they both got a giggle out of it. I just don't understand why some people feel that seeing a breast is a bad thing, but that all the crap shown on WWE, for instance, is perfectly fine for kids to watch.

3. Contrary to popular belief, seeing nipples, or hearing Carlin's 7 dirty words does not harm kids.
Therefore, restrictions on the broadcast of such images or utterances is unconstitutional.

6. Censorship is not for children. It's for the adults.
It's to keep adults from being embarrassed. At least this is what I've always thought.
