Bush administration appeals injunction against Partial Birth Abortion Ban Act

SAN FRANCISCO (AP) - The Bush administration on Monday appealed a federal judge's June order blocking enforcement of a federal ban on a type of abortion.
U.S. District Judge Phyllis Hamilton, in a challenge brought in San Francisco by Planned Parenthood Federation of America, ruled the ban was an unconstitutional limitation on a woman's right to choose.

The law, which President Bush signed in November, is aimed at stopping a procedure, usually performed during the second trimester of pregnancy, in which a fetus is partly delivered, its skull punctured and its brain removed, often by suction.

Justice Department attorneys argued the procedure is inhumane, causes pain to the fetus and is never medically necessary. A government lawyer told the judge that it "blurs the line of abortion and infanticide."

1. Why is a fetus more important than a
Fully grown woman?

A fetus should never, FRICKING NEVER have an overriding vote over the woman who is pregnant. Period.

Women should live before a fetus, and if you think otherwise, you are a fricking misogynist. Period.

3. catholic hospitals will save baby first and let woman die.....
I remember when I was younger most catholics I knew said don't have your baby in a catholic hospital

... to learn that "Justice Department attorneys," who often seem so grossly inept at "Justice," are so well-trained in medicine that they can, across the nation's entire population and on into the indefinite future, determine that a medical procedure is "never medically necessary" contrary to the opinions of (obviously less capable) doctors and their patients. (They must, after all, choose between opposing expert opinions on the matter, obviously based on their immensely superior Ashcroftian medical knowledge.)

When those "Justice Department attorneys" (who are also anointed experts on legal torture) argue about such a medical procedure being "inhumane," I take great solace in the fact that treating prisoners 'detainees' with attack dogs, humiliation, sleep deprivation, immersion, and stress positions isn't being done by trained doctors to a fetus that's not viable and poses a grave risk to the mother. After all we gotta know our moral priorities, right?

They sure gotta have one helluva lot of "actionable intelligence" in that there (omnipotent) Justice Department.
