More Trouble for Judith Miller and 'New York Times': Subpoena in Plame/Novak Probe

Lawyers for The Times said the paper expects it will be served a separate subpoena for its records. They said the paper would fight both subpoenas.

According to an article in the Times on Friday, Publisher Arthur Sulzberger Jr. said, "We regret that the special prosecutor has chosen to issue a subpoena that seeks to compel Judy Miller to reveal her confidential sources. Journalists should not have to face the prospect of imprisonment for doing nothing more than aggressively seeking to report on the government's actions. Such subpoenas make it less likely that sources will be willing to talk candidly with reporters and ultimately it is the public that suffers."

3. It's a different matter when the information disclosed ...
is highly classified and a matter of national security. If the information disclosed had been classified "top secret" or equivalent, I think the reporters should be compelled to disclose who leaked the information. The public has an interest in preventing officials from releasing classified information for political purposes. This interest outweighs the damage to a free press in this case.

4. What about Novak?
They're harassing these other journalists and it seems like they're giving the real perp, Novak, a pass on this. He's the one who outed Plame in his article yet we haven't heard a thing about the government going after him.
I WANT NOVAK IN JAIL!

...to the press) be a confidential source?

Even if that employee tells the reporter the information is not for attribution (or whatever), how can you say that a person sitting at a desk the taxpayers paid for, talking on a phone for which the taxpayers are paying the long distance bill, doing a job for which that person draws a check from the public treasury is acting in a confidential capacity?

These government people are not whitleblowers and their not private parties, acting in the capacity of private citizens. They're doing their jobs.

I do not understand how you can have a confidential relationship with a public employee acting in their capacity as a public employee.

6. The Times should have fired Judy a long time ago.
Right after they found out that her 'cheerleading' the Iraq war with her fake WMD stories all based on info from her ONLY source the con-artist Chabali. What a disgrace, made worse by the Times 'mental breakdown' over small fry Jason Blair. I don't know what she has to do with Plame but I hope she's goes to jail. I don't think the press should give up their sources but it's the Times's own fault in this case. They knew what she was and didn't deal with it. Now she's got them in an even bigger mess. They should have known this would happen.
They probably still won't fire her.
