Federal judge in Tacoma rules Defense of Marriage Act constitutional

Married lesbian couple loses argument in bankruptcy case

By ADAM LIPTAK
THE NEW YORK TIMES

A 1996 federal law that defines marriage as "a legal union between one man and one woman" is constitutional, a federal judge in Tacoma ruled Tuesday. It is the first decision of a federal court to address the constitutionality of the law, the Defense of Marriage Act.

The decision is not binding on other courts, and the question of the constitutionality of the marriage law is likely to give rise to many decisions in coming years.

The Tacoma decision arose from a bankruptcy filing. Lee and Ann Kandu, two American women, were married in British Columbia last August and filed a joint bankruptcy petition in Tacoma two months later. The Justice Department opposed the joint filing, saying the federal marriage law forbade it.

Snyder ruled that there was no fundamental constitutional right to marry someone of the same sex and that it did not violate the equal-protection clause of the Constitution to allow opposite-sex couples to marry but to prohibit same-sex couples from doing so.

3. This issue isn't over
until the 9 supreme court justices issue their ruling.

The DOMA is on the wrong side of history and even the right wing knows it (else they wouldn't be trying to change the constitution).

6. there is really no marriage biblically
If you read chapter 1-2 especially chapter 2 of Genesis, there wasn't marriage between Adam and Eve. God made man just like how he made the beasts of the field. To take a woman or a mate for himself. That was what Adam did. The Bible only recognize the Wedding. The Bible don't recognize marriage or divorce.
