Sir Mark Thatcher has managed to postpone being questioned under oath about his alleged involvement in a failed coup in Equatorial Guinea.
The son of former Prime Minister Baroness Thatcher had been subpoenaed to appear in the Wynberg Magistrates' Court on Wednesday after the government granted an Equatorial Guinea request to question him about allegations he financed part of the coup attempt.
"The whole question of whether he should be required to answer any questions at all is what is being challenged," said Thatcher's lawyer, Alan Bruce-Brand.
The lawyer held talks with Judge President John Hlope correct in chambers at the Cape High Court and argued that it was unconstitutional to subpoena Thatcher to answer questions from Equatorial Guinea while he has related South African charges pending.
