DEA Battle to Ban Hemp Food Over
Food products made with hemp will remain legal after the Justice Department declined to challenge a ruling that overturned a Bush administration ban, lawyers for the hemp industry said.

The appeals court decision was a victory for more than 200 companies that make products including energy bars, waffles, milk-free cheese and veggie burgers with the plant that contains only trace amounts of THC, the key ingredient in marijuana.


Monday night was the deadline for the government to challenge a federal appeals court's February decision that the United States cannot ban the domestic sale of hemp foods.

The San Francisco-based appeals court said that although the Drug Enforcement Administration has regulatory authority over marijuana, the agency did not have the authority to ban foods derived from hemp. The court said it was not possible to get high from products with only trace amounts of the mind-altering chemical.

1. I remember a hemp-"infused" beer
that I hope comes back. Great-looking packaging, but not a killer brew, unfortunately, just good enough.

Chapter 13 (Drug Abuse Prevention and Control)

Section 802

(16) The term 'marihuana' means all parts of the plant Cannabis sativa L., whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture or preparation of such plant, its seeds or resin. Such term does not include the mature stalks of such plant, fiber provided from such stalks, oil or cake made from the seeds of such plant, any other compound, manufacture, salt, derivative, mixture or preparation of such mature stalks (except the resin extracted therefrom), fiber, oil or cake or the sterilized seed of such plant, which is incapable of germination.

As far as I know, you can still order huge 50 pound bags of sterlized hempseed (sold for birdseed) from China (where hemp is grown industrially). I've done this to make various hemp foods, and discovered that in a 50 pound bag of hempseed, you'll usually find about a half ounce of 'shake', ie., dried leaves.

Tried smoking them once -- COUGH GAK! BAD IDEA! also gave me a bad headache. Don't smoke the shake in the bottom of the birdseed bag! Trust me!
