``Well, our executive doesn't,'' Clement stated.

``Is it just up to the goodwill of the executive?'' Ginsburg asked. ``Is there any judicial check?''

Not much, Clement answered. ``You have to trust the executive to make the kind of quintessential military judgments that are involved.''
