Ashcroft rightly rebuffed (Oregon assisted suicide law)
The 9th U.S. Circuit Court of Appeals has delivered what should be Attorney General John Ashcroft's ultimate judicial rejection of his attempt to usurp both the voters' will and states' rights in Oregon.

Although voters have twice approved that state's Death with Dignity Act, Ashcroft has tried to use the federal Controlled Substances Act to punish Oregon physicians who help their patients commit suicide.

Rebuked by the trial court, the Bush administration lost its appeal to a three-judge panel of the 9th Circuit in May. The panel ruled that Ashcroft's behavior "far exceeds the scope of his authority under law." Monday, the full court rejected Ashcroft's request for a review of that decision.
