.............can Ashcroft still be charged with contempt of Congress by not deliver them???????????

1. One would think if he did not deliver them to Congress, yes, he would be
in contempt. One would also surmise that if something is already on the internet, the junta cannot make any silly executive privilege claims

4. The repubs would have to agree to the subpoena and...
from the ass-kissing that went on from the repubs yesterday during the hearing, that doesn't look likely, at this point anyway. If there were to be a subpoena for them, I wonder if the case would go, in the end, to the USSC?

8. welcome to DU, kofijoe ... the memos relate to dimson's position
on Geneva Conventions being applicable to conflict in Afghanistan (and then Iraq by consequence) ... here are links to 2 of the memos, one by WH counsel Gonzales (jan 25 2002) and Powell's response (jan 26 2002); note that these memos refer to the "OLC" which is the Office of Legal Counsel within the Justice Dept (read: A$$croft) -- there are supposed to be many more memos, but A$$croft yesterday defied the Senate Judiciary Committee in his appearance claiming HE WILL NOT release those many memos to Congress because of the same ol' "national security" and "executive privilege" crappola we've been hearing for years ...
all this brouhaha got his the now-famous Biden response of: 'YOU MAY BE IN CONTEMPT OF CONGRESS'

12. The memos on the internet--IIUC--have an anex that isn't on the internet
and that annex presumably describes exaclty what they were doing in the prisons (what kind of torture they were using).

It's that document that congress wants Aschcroft to produce.
