can smirk pack scotus as a lame duck?
in general, people with ethics who are voted out in november don't do anyhting drastic in the 2.5 months before the new president and congress are sworn in. But * is the least ethical person i can think of, and has used recess appointments to stack the lower courts with filthy idealogues who wouldn't have a prayer of making it through a vote. Could he do the same this year after Kerry wins in november?

2. Conceivably, but "recess" appointments..

only last one year before they must be resubmitted to the senate. Then Kerry appoints their replacements.

I guarantee that Bush and his cohorts will do everything they can to put hard right judges on the bench up to the very last minute. They have no respect for tradition, decorum, or decency.
