U.S. negotiating Hamdi's release
Detainee Hamdi May Be Released from Navy Brig

Talks are under way between government lawyers and the lawyer for Yaser Esam Hamdi, a U.S. citizen held as an enemy combatant, for his release. Hamdi was captured on a battlefield in Afghanistan in 2001 and is currently being held in a Navy brig in Charleston, S.C. NPR's Larry Abramson reports.

There are only two options here, both of them bad: either the U.S. imprisoned an innocent man, or they fucked up a criminal investigation so badly that they have to let a terrorist go. Which is it? Incompetence or malignance?
