San Jose girl used wits to escape kidnapper

A San Jose girl who was kidnapped and repeatedly sexually assaulted continued testifying today against her alleged abductor, telling a remarkable story of bravery and quick thinking.

On Tuesday, the 11-year-old girl began her heavily anticipated testimony in Santa Clara County Superior Court against David Montiel Cruz, the man who allegedly held her captive for three days in a terrifying ordeal last June. With poise and a quiet confidence, the girl, who said Tuesday she slept in her mother's bed the night before her abduction because she was scared of the dark, today outlined the events of June 6, 2003 when she returned home from school to find Cruz at her house.

She described how, after three days of captivity, she faked an asthma attack, allegedly prompting Cruz to drop her off at an East Palo Alto liquor store just outside the Santa Clara County line.
After Cruz allegedly threatened to kill her if she spoke with authorities and told her that he planned to return to Mexico, the girl exited the car and walked toward the store "feeling happy," she said. However, once inside the store, she began sobbing when the store's owner asked if she was the missing girl from the news reports.

"Yes I am," she replied.

On KY. Prisoners tend to take a less than charitable view towards child abuctors and molesters...most have kids themselves they never get to see. I give him about a week before they find him with his head bashed in.
