Woman Fired because of Kerry/Edwards sticker on her car

Moulton woman says she lost job for sporting Kerry sticker on car

By Clyde L. Stancil

MOULTON — Lynne Gobbell never imagined the cost of a John Kerry-John Edwards bumper sticker could run so high.

DAILY Photo by Clyde Stancil
Lynne Gobbell said her boss fired her last week because of the Kerry-Edwards campaign sticker on the back of her car.
Gobbell of Moulton didn't pay a cent for the sticker that she proudly displays on the rear windshield of her Chevrolet Lumina, but said it cost her job at a local factory after it angered her boss, Phil Gaddis.

Gaddis, a Decatur bankruptcy attorney, owns Enviromate, a cellulose insulation company in Moulton.

Gaddis did not return phone calls from THE DAILY about the alleged Thursday firing.

Gobbell said she consulted a lawyer, but then changed her mind about going to see him. She said she has cried about the incident and must do without income for three weeks while the state unemployment commission decides if she is eligible for compensation.

Gobbell said she was averaging 50 to 60 hours a week on the plant's bagging machine.

"The lady there (at the unemployment commission) said that she has never heard of a firing like this before," Gobbell said.

Gobbell gave this account:

"We were going back to work from break, and my manager told me that Phil said to remove the sticker off my car or I was fired," she said. "I told him that Phil couldn't tell me who to vote for. He said, 'Go tell him.' "

She went to Gaddis' office, knocked on the door and entered on his orders.

"Phil and another man who works there were there," she said. "I asked him if he said to remove the sticker and he said, 'Yes, I did.' I told him he couldn't tell me who to vote for. When I told him that, he told me, 'I own this place.' I told him he still couldn't tell me who to vote for."

Gobbell said Gaddis told her to "get out of here."

"I asked him if I was fired and he told me he was thinking about it," she said. "I said, 'Well, am I fired?' He hollered and said, 'Get out of here and shut the door.' "

She said her manager was standing in another room and she asked him if that meant for her to go back to work or go home. The manager told her to go back to work, but he came back a few minutes later and said, " 'I reckon you're fired. You could either work for him or John Kerry,' " Gobbell said.

"I took off my gloves and threw them in the garbage and left," Gobbell said.

Though she is unemployed and uncertain if she will get her job back, Gobbell said, she doesn't regret her decision to keep the sticker on her windshield.

"I would like to find another job, but I would take that job back because I need to work," she said. "It upset me and made me mad that he could put a letter in my check expressing his (political) opinion, but I can't put something on my car expressing mine."

She was referring to a flier that she said Gaddis placed in employee envelopes to remind them of the positive impact that President Bush's policies have had on them. An employee at the plant who would not identify himself confirmed the contents of the letter.

Gobbell provided a copy of the flier. It says:

"Just so you will know, because of the Bush tax (cut):
# I was able to buy the new Hammer Mill
# I was able to finance our receivables
# I was able to get the new CAT skid steer
# I was able to get the wire cutter
# I was able to give you a job"

It further says:

"You got the benefit of the Bush tax cut. Everyone did."

1. This is the difference between politics in Old America
and politics in Bush's Amerika. These kind of guys see the Republicans running roughshod over everyone and everything in their way, and they take it as a signal that they can now act with impunity. The bullies are out in force, the gloves are off, and the Repubs are busy stacking the courts with morons who will find legal justification for employers who act as this man did.

I will be one of the old ones who will remember when it was OK to disagree with the elected government.

14. Yep. I miss Old America.
I still remember when we lived free, not this pale (but relatively pleasant to Amerika 2050) shadow.

2. Wasnt the smartest move to challenge him

especially in front of others and make it an ego/honor thing.

She should have just ignored the order and made him take the provocative action.

Of course, now he'll claim she was substandard in her work and it had nothing to do with politics.

21. From the article he never ever directly said she was fired
All we have is the direct supervisor saying (according to the complainant) "I reckon you're fired".

Even the quote "I'm thinking of it" that was attributed to the owner could be applied to thinking of firing her for her unprofessionalism of challenging the owner while he's in a meeting.

Note - the boss never invited her in to specifically discuss the bumper sticker but responded to a knock on his door.

26. should haves don't count after the fact
when one has the leisure to sit back and digest a situation, not being in the middle of it when it was going on, but reading about it after the fact, it's easy to 'armchair quarterback' the situation... We all 'shoulda-woulda-coulda', but we weren't there facing it, so that's moot.

His actions were illegal and unconstitutional. She'll be owning his butt before too long.

5. The ACLU will be all over this.
Scary! The plant manager seemed to benefit from Bush's tax cut, but I'll bet he didn't pass that on to his employees. Wanna bet he didn't pay overtime? 'I was able to give you a job.' 'I, I, I' Or take it away by violating your Constitutional right to free speech. What a prick. I hope she sues this bastard for all he's got.

10. Is this a "Right to Work" state?
If so, she's fucked.

"Right to Work" is a misnomer. It comes from the idea that workers have a "Right to Work" without having to join a Union.
What it actually is is a "Right to Capriciously Fire" for Employers. Don't like your politics? you're FIRED. Won't sleep with me? You're FIRED. I got heartburn and you're smiling? You're FIRED.

And the state always takes the employer's side. All the employer has to allege is sub-standard performance or insubordination.

Gaddis is SCUM. Probably trying hard to earn a Bush Pioneer spot.

What Speech Does "Hostile Work Environment" Harassment Law Restrict?
http://www1.law.ucla.edu/~volokh/harass/breadth.htm

http://www.sh.lsuhsc.edu/HR/HRM/Employee%20Relations/Harrassment.htm
What is harassment in the workplace?

Conduct relating to an individual which has the purpose or effect of creating a hostile, intimidating or offensive work environment, or
of unreasonably interfering with an individual's work performance.

Harassment also includes any form of physical or verbal abuse of such significant character and nature that no person of reasonable sensitivities should be expected to tolerate it in the workplace. Harassment can occur as a result of a single incident or a pattern of behavior.

What else could be considered workplace harassment?

Political discussions regarding such topics as Africa, Israel, etc.

http://slate.msn.com/id/3659/entry/23961/
On my Web site, I document case after case where courts and agencies say that political speech, social commentary, and religious proselytizing can be illegal "harassment." And when courts and agencies talk, employers listen.

AB 1617 Puts Teeth Into the FEHA to Fight Workplace Harassment

* Jan Tucker did the initial draft of AB 1617 which has now been introduced into the California legislature by Assembly Member Cindy Montanez (D-39th District). The legislation will give guidance to employers on what steps they must take to prevent workplace harassment and make clear that you cannot get away with conducting an incompetent investigation of harassment.

22. That could be strictly for aesthetic reasons
Unless Bush/Cheney signs are hanging around and not being responded to I would think a property manager can dictate what can hang on door fronts or be visible from windows.
