Man jailed for putting noose on black teen
Edited on Tue Jan-11-05 03:31 PM by livinginphotographs
"CLEARWATER, Fla. - A man accused of draping a noose around the shoulders of a black teen at a fast food restaurant was sentenced Monday to 60 days in jail.

The judge also sentenced Louis Giannola IV, who was convicted in December of misdemeanor battery, to 10 months probation and community service. He was spared a harsher sentence because jurors declined to label the incident a hate crime.

<snip>

Giannola was arrested after he draped a noose around the neck of Hall, 15, while they and other teens were at a Wendy’s restaurant in Largo in January 2004. Prosecutors contend some people Giannola was with were heard making racial slurs."

What a poor excuse for a human being. The son of a bitch should've been given WAY more than 60 days in jail.

5. Not a hate crime? WTF!
> jurors declined to label the incident a hate crime.

Can the jurors be arrested for doing something like that? Why are jurors held accountable for their actions?

7. They can't be arrested.
This was at their discretion whether to consider it a hate crime.

With that said, I completely agree with you that they were wrong not to consider it a hate crime; this was CLEARLY a hate crime. That poor kid who this was done to is going to need a lot more than 60 days to get over some fuckwad putting a rope around your neck.
