Who has legal knowledge re: cyber-stalking and harrassment?
The Freepers have decided to harrass Andy in his hospital bed. Is this criminal harrassment?

The signed return receipt from Western Union--if the recipient of the telegram (linen parchment paper, remember; only the best for Andy) can be located--is then mailed, regular U.S. mail, back to the person sending the telegram.

Since this is Nebraska, and that is Maryland, and since the telegram was sent so as to arrive on Friday, one assumes Tuesday, maybe, I will have the signed return receipt.

I thought it was a great telegram, full of only the best and sincere wishes for Andy, from the DUmmie FUnnies.

4. No law against sending a telegram
let them waste their money. There are laws concerning cyber stalking and some are stiff depending on what state you are in and what proof you have. This would not rise to the level of cyber stalking.

7. this post in particular might not be cyber stalking
but could it be criminal harrassment? they have pursued him all over the internet, delayed his treatment by making a false complaint about his Paypal acct, and now they are sending unwanted communications to his hospital room.

as far as the other claims, Andy would have a better civil case than a criminal case since attempts to thwart his medical care were organized both by Freerupublic and ConservativeUnderground and both sites were part of a "deliberate scheme to discredit" with the knowledge of their administrators.

Note to lurking freepers: I put the specific legal language in quotes so you can run right back to the slobs that run those sites and tell them.

What was done was shocking, but the fact is that Andy's all right now, recovering nicely, and whatever pranks anyone pulls have absoutely nothing to do with him.

So, please don't rise to the bait. Do not rise to the bait. Reserve your outrage for Iraq, our failing country, our civil and legal rights being eroded daily, and the fact that the Democrats seem to have misplaced their spines.

Ignore them. It's already moot.

One more thing: it's probably not good for anyone's mental or physical health to go to freerepublic.com. Just a thought ..............

through that nasty thread. Amazing isn't it? I have one thing to say to those idiots over there. Phones are not allowed in the ICU rooms routinely but if patients are in good shape and still required to stay there for a time a phone can easily be brought into the room. Think you idiots. What were they trying to prove with that silliness?

Harassment. They should be so ashamed of themselves.

At this point, I suggest keeping us informed of any developments or problems via email/PM which they cannot monitor.

If they cross the line, they will be prosecuted.

Any written communications sent to the hospital should be retained for possible future use. Any threatening or harassing communications should be turned over to the police along with the link to FreeperLand and Ms. Harris' address which I can provide.

department's cyber crime division. They'll subpoena the IP addresses and take it from there. PM me for more info on what you need and who to talk to.

Has anyone archived those threads? I've got the threads that were pulled, as well as this one so far.

You may very well be correct in the pancreatitis. He had a tumor on the bile duct that collapsed it and a shunt was placed.

All this crap about having to wait at least a week to find out 'what kind of cancer it is', is a smoke screen by the inner circle, in hopes that this will get put on a back burner.

I'll put up money that sometime towards the end of next week we will see an 'OMG.. Andy got the best news today..He is sooo lucky...etc etc'. Then the group hug will start and they will shout down anyone who questions the shilling of 'pancreatic cancer', 'death's door','he will die without the Whipple', 'JH has the best survival rate' etc back in April.

The people of the inner circle of this are so arrogant, and the dupes at DU are so stupid it is amazing.

There are two plausible reasons for all of this:

Andy heard 'possible pancreatic cancer' from his Dr in Wa and freaked, sfexpat took it unto herself to 'get him the best care' without finding out what he actually suffered from, started the money shill and now has to cover up all of her mistakes.

Andy is in trouble in WA. and if he had the necessary surgery there, he would have to get rid of all assets, open up his financial books for scrutiny, and possibly Termite might have to sell the house. So he gets his syncopates to start the 'Andy's gonna die' shill and gets accepted to a very fine out of state facility for the procedure.

I just wanted to check in for a moment.

I, too, received an unexpected delivery today to my residence. A Duer kept PMailing me this question: Do you have any rice? The whole thing was sort of disturbing.

First thought, we'd been caught up in this horrible web of hyperscrutiny and harassment and downright stalking. And this time, it was obviously an inside job. :(

Then, there was a knock at the door and it was the postman with a package. A suspicious package, white Styrofoam. And I didn't recognize the sender. Now what do I do?

Who was this "Mary Mahoney" and how did she find me? Okay, well we're in the phonebook but, forget that. I took all the pets into another room while Doug opened it. (I told him to be careful but didn't worry as he's so big, if he got blown up, I could probably piece together a reasonably good facsimile.)

Well, they did it this time. A DUer sent me some really fine gumbo which we're fixing to eat as soon as it finishes thawing. Unless I can't hold Doug back, and he sucks it frozen. :eyes:

28. Washington State has cyberstalking laws
Sec. 1. A new section is added to chapter 9.61 RCW to read as follows:
(1) A person is guilty of cyberstalking if he or she, with intent to harass, intimidate, torment, or embarrass any other person, and under circumstances not constituting telephone harassment, makes an electronic communication to such other person or a third party:
(a) Using any lewd, lascivious, indecent, or obscene words, images, or language, or suggesting the commission of any lewd or lascivious act;
(b) Anonymously or repeatedly whether or not conversation occurs; or
(c) Threatening to inflict injury on the person or property of the person called or any member of his or her family or household.
(2) Cyberstalking is a gross misdemeanor, except as provided in subsection (3) of this section.

(3) Cyberstalking is a class C felony if either of the following applies:
(a) The perpetrator has previously been convicted of the crime of harassment, as defined in RCW 9A.46.060, with the same victim or a member of the victim's family or household or any person specifically named in a no-contact order or no-harassment order in this or any other state; or
(b) The perpetrator engages in the behavior prohibited under subsection (1)(c) of this section by threatening to kill the person threatened or any other person.

(4) Any offense committed under this section may be deemed to have been committed either at the place from which the communication was made or at the place where the communication was received.

(5) For purposes of this section, "electronic communication" means the transmission of information by wire, radio, optical cable, electromagnetic, or other similar means. "Electronic communication" includes, but is not limited to, electronic mail, internet based communications, pager service, and electronic text messaging.

32. thanks - I think for the telegram applicable law would have to be Nebraska
Nebraska, where the telegram originated, or Maryland, where it was sent. But for the previous stuff we can look at the WA laws, thanks.

DU doesn't allow this behavior; the admins removed the posts. I wonder if FR has similar rules?
