Liberal Lady Lawyer Runs Rings Around Bill O'Reilly on Subject of GITMO Detainees

For all his bluster and bravado, yesterday <5/24/05> Bill O'Reilly was bested by his guest, law professor Rosa Brooks, a feisty, strong, knowledgeable human rights attorney who did a wonderful job of driving Bill crazy! After his usual hateful Talking Points Memo, in which he tried to justify his inflammatory "beheading" statement about Michael Kinsley of the L. A. Times, the Bloviating Billster took on Ms. Brooks in a long segment on the topic of the Guantanamo detainees. They were still at it well into the "cut to commercial break" theme music. Bill was a mass of frustration by the end of this verbal sparring match. One wonders if Ms. Brooks will ever be asked back again! Here's the (long) transcript.

If you want to change the speed of the scrolling text, try this: change the tag from <marquee> to <marquee scrolldelay=500>. Adjust the number to adjust the speed.

O'Reilly lies, and she doesn't know her stuff well enough to call him on it:

Not only is it wrong, not only does that text appear nowhere in the four Geneva Conventions, but she fails to point out the relevant text that does:

(1) Persons taking no active part in the hostilities, including members of armed forces who have laid down their arms and those placed hors de combat by sickness, wounds, detention, or any other cause, shall in all circumstances be treated humanely, without any adverse distinction founded on race, colour, religion or faith, sex, birth or wealth, or any other similar criteria.

To this end the following acts are and shall remain prohibited at any time and in any place whatsoever with respect to the above-mentioned persons:

(a) violence to life and person, in particular murder of all kinds, mutilation, cruel treatment and torture;

(b) taking of hostages;

(c) outrages upon personal dignity, in particular humiliating and degrading treatment;

(d) the passing of sentences and the carrying out of executions without previous judgment pronounced by a regularly constituted court, affording all the judicial guarantees which are recognized as indispensable by civilized peoples.

(2) The wounded and sick shall be collected and cared for.

This is one of the reasons why Bill gets away with it.

She got rolled by O'Reilly. She had a stellar chance to take him to the mat, and she blew it.

Because she was not able to point out the facts, anyone with any reason at all who just happened to have the Factor switched on now thinks the Geneva Conventions only protect people in uniform.

On Edit: I feel compelled to add that she was attempting (albeit unsuccessful due to O'Reilly's constant interruptions) to qualify her "unit" point with the REQUIREMENT that qualification for protection under the Geneva Conventions must be determined by an OUTSIDE PARTY, i.e., not the USA itself.

Perhaps she did mis-speak ... I'm honestly not sure. What I am sure of is that she showed remarkable resilience and a sharp wit for being verbally mocked (cheap shot - verbal rabbit punches) by that immoral and unethical ... oh, that nasty man.

37. I think you both make valid points. Absolutely.

Going on cable against a loudmouthed bully is difficult and the presentation is not going to be perfect. There will be things that we wish would have been said differently and information that we would have wanted brought out.

In my layman's opinion, Brooks held her ground well, certainly not perfectly, but well. And O'Reilly when faced with the weakness of his argument and his usual dearth of facts became flustered and belligerent.
