If Rove and or Libby are indicted on Conspiracy and obstruction charges

2 question, 1) how high would their bail be and 2) could they plead out, start singing and avoid jail time?

1. If I were Libby's or Rove's lawyer

I would get bail set for them (it won't be high), and immediately start hinting that they could throw some bigger fish to the prosecutor. I would claim that Bush and Cheney's refusal to testify under oath impedes my client's ability to defend himself and insist that I be allowed to depose both under oath. That would insure a court case that will go to the SC and take months or years to resolve.

If we win and get Cheney and Bush under oath, we pin the whole war plot on them. If we lose and they don't have to testify, we paint them as ruthless liars who used their SC cronies to place themselves above the law and my client as a poor underling who was used and cast aside to take the fall for Bushco while they got rich off war profiteering.
