Scrap hate crime laws. They waste space on the books, took (or will take) time and money to implement that could be better spent, and so forth. There's a much more effective way to deal with hate crimes these days.
Charge people who would normally be charged with hate crimes...with terrorism.
What is a hate crime? A crime against a member of a specific nationality, ethnicity, or other grouping of people. What is its purpose? Not just to hurt that one person, but to intimidate others of that persuasion, whether in the immediate area ("No niggers in this neighbourhood!") or everywhere ("This'll warn them fags to get out of the U S of A while they still can!").
Sounds an awful lot like terrorism to me.
And I bet the followers and adherents of, say, the Westboro Baptist Church would be a lot less eager to push their luck if they knew they could be shipped off to Gitmo in a twinkling. (On that last part I am just teasing...but considering the punishments on the books for terrorism, even abiding by due process might deter some would-be hatin'.) Hey, maybe we could even send Ashcroft to Abu Ghraib, considering the way the anti-terrorist policies he espoused have been implemented.
