Gay Marriage Constitutional Bans
following was posted in response to the Louisiana passage, on a board I refuse to post to anymore, because conservo-creeps flamebait too much over there, and they never get deleted, but a liberal who finally, even after two years of constant harrassment, finally RESPONDS to the flamebait...gets deleted.

But, I still look in on the board to see what is being said.

I found these responses in reply to the Louisiana ban...and, while I won't post over there, I can't resist replying to it...and so I'll post the quotes here, and my comments, and see what y'all think...

Response #1
* Claps * Thank you my Southern' breathren for banning such a awful thing. Im a Tenneseean, and im a Republican, Right-Wing, Conservitive, what ever the hell you want to call it.

Response #2
Well....states have the right to recognize what they want to. THAT comes down to "states rights" and I do happen to agree with that.

Response #3
You think states have the right to violate the Bill of Rights?
Full Faith and Credit are part of the US Constitution, enumerated by the rights in the Constitution and not subject to the 10th ammendment. Hence, a State not recognizing another State's legal contract is unconstitutional.

Response #4
As I know nothing about this topic, I'm asking not telling. Are there any other kinds of legal contract that are currently made in one state and ignored by another? Does Alabama not recognise wills made in Florida or something?

MY response is more directly towards Response #4.

Actually, yes. If you commit a felony in the State of Texas, you are allowed to get your voting rights back upon completion of all periods of incarceration, probation, parole, and after having paid all fines/community service attached to your sentance, and are free from all court supervision. At that point, you get your voting rights back in Texas.

But if you have that in your history, and go to Florida...they will take away your voting rights again!! Even though the felony was committed IN TEXAS...AND, Texas even gave you your voting rights back...Florida would not allow such a person to vote!

So there IS some precedent to one state not recognizing rights granted citizens by other states. How legal this is...well, that is a question that may never be well and truly sorted out...but there is precedent for it.
