Man dies after fight over right to sunbathe nude on bar terrace

A man who put up his fists for the right to sunbathe nude outside a bar in San Francisco's Castro neighborhood has died of injuries he suffered in the fight, police said Tuesday.

Jay Carbone, 52, hit his head during the scuffle at the Pendulum bar and died at Davies Medical Center. No one has been arrested, but police are investigating whether homicide charges should be brought.

Police Inspector Herman Jones said the incident had occurred Thursday afternoon when Carbone came to the Pendulum on 18th Street, ordered drinks, disrobed on the back terrace and proceeded to sunbathe.

After about an hour, another patron complained to Carbone and asked that he put his clothes on.

"If you don't like it, get out,'' Carbone told the offended man, Jones said.

The patron went inside and complained to the bartender, Jones said, then went back out onto the terrace.

4. The whole scuffle could have been avoided

if the annoyed patron had initially made his complaint to the bar tender instead of the naked patron. He had no right to tell the guy to put his clothes on in a private establishment; that would be up to the management. If the management said it was OK to be nude there then the annoyed patron could take his business somewhere else. This guy died as a result of cumulative macho assholism.
