Dear -----, et cetera...

As you know, Sinclair Broadcasting has planned the preemption of
regular station programming in order to broadcast an attack
documentary focusing on Senator John Kerry that is expected to
last approximately 90 minutes. Certainly, this raises serious
questions as to whether this is a proper use of public airwaves.
Indeed, it would appear to conflict with the fairness rules now in
place at the Federal Communications Commission (FCC). To
allow a broadcasting company to air such a blatantly partisan
attack in lieu of regular programming, and to classify that attack as
"news programming", as has been suggested, would at best go
against the spirit of the rules governing political advertisement, and
at worst violate current law and regulations.


A group of my Senate colleagues has petitioned the FCC to
investigate this matter and, given the political content of that
programming, to determine whether any laws or regulations have
been broken. It is my hope that with the Presidential election so
near, this inquiry will be conducted as expeditiously as possible.
