You're right, though. The first couple of bars are remarkably similar.
Maybe this song didn't make it into the canon of standards because it was released during a year in which rock and roll tunes were dominating the charts. (or maybe it was because Pat Boone sang it!)
6. I know it was a number one song for a couple of weeks.
I was merely talking about its staying power. (and even then, just offering my own experience as anecdotal evidence...)
For what it's worth I've at least heard every other number one song around the 12 month span of April Love's chart topping status, and have either played those songs or had them requested.
4. I wonder if its too late to sue....I am certain there would be a lawyer
somewhere who would really like to take this.
Led Zep was sued by Howlin' Wolf's guitarist Hubert Sumlin for stealing the song,"Killin' Floor" and simply slowing it down and adding a different break and never paying him or even crediting him with writing the song, which he did. Sumlin won several million bucks in a settlement. This happens all the time.
