For those of you following the Dudley Hiibel case
the transcript of the oral argument before the Supreme Court is available here:

I'm less than optimistic since 13 pages into the transcript at least one of the justices seems to think Hiibel was driving.

Then there's this gem:

QUESTION: Why isn't the -- maybe you and I differ on -- on what the -- what the course of a responsible citizen is. I would think the course of a responsible citizen would be to answer the question what you're doing here and what your name is. And if he doesn't answer that, I would -- I would say that that make -- may cause the situation to rise to the level of probably cause.

1. Interesting conundrum
It will end up that only the guilty are afforded the right to privacy and to plead the fifth, but doing so will constitute probable cause.
