1. Except FISA isn't the issue...
it's why this putz didn't go to FISA Court with the requests rather than doing an end-run around it. FISA is a non-issue except for this very specific point.

I believe Carter’s Executive Order only applied to surveillance overseas and not to US citizens. Nowhere in the EO does Carter say that he’s seeking domestic intelligence, or information from US citizens within the United States, or anybody within the United States for that matter. (That doesn’t mean Carter didn’t also round up Iranian Americans.) This EO in question doesn’t imply that Carter did the same thing Bush did. Bush admits to using the NSA to spy on US citizens within the United States who, presumably, are communicating with those outside the US.

5. This stood out:
" None of the above officials, nor anyone officially acting in that capacity, may exercise the authority to make the above certifications, unless that official has been appointed by the President with the advice and consent of the Senate."

9. This stand way out!!!!!!!
" with the advice and consent of the Senate."

The Senate never gave such approval. I think Condi was referring to the Patriot Act etc... which the Senate did authorized...but NOT THIS...I sense they jumped the gun and assumed they were cool.

NOT!!!!!!

Do I have it correct?

6. read it: "to acquire foreign intelligence"
I'm afraid the freeper's domestic intelligence is too low to realize that this has nothing to do with Bush's homeland spy squads
