T shirts illegal in two states? Why, Where?
A DU advertiser, called "Carry A Big Sticker," advertises a t shirt that lists all the names of America's dead in IRaq. The ad says it is illegal to wear the shirt in two states and possibly illegal in the entire US sometime soon. On the front it says ,"Bush lied." then lists ann the soldiers killed by Bush. Anyone know anything about this. Maybe it's my state and i'd be arrested? Certainly an assault on my First Amendment rights, so whats new.

1. by the way
The advertiser gives no background about the claim that the shirt is illegal. They should. I am sort of inclined to purchase the shirt, just as a first amendment rights' issue.

2. It is based on names of dead soldiers
Including some who, according to their next of kin, would want nothing to do with an anti-war shirt.

I'm torn on this... I think the next of kind have some right to privacy, but war dead are a matter of public record and this is clearly protected political speech. I don't know.

simply to keep protest silent.. to keep anyone from shouting the Village idiot has no clothes..
the names are so small you cant read them without a magnifying glass, this is just another violation of the constitution

27. Like you said, their names are part of the public record
Bush is the one that doesn't want anyone else outside of military families know who the fallen are. No pictures of returning fallen are allowed.

3. the ad states: "Selling this shirt is illegal in two states and may soon be illegal nationwide."
as well. i expect this is more accurate than the general claim of "this shirt is illegal..."

i wonder which 'two states' those are?

4. This was all I could find:
http://www.katc.com/Global/story.asp?S=4588316

One bereaved, deluded, RW mom who thinks wanting peace "degrades" her dead son.

That's an opinion, not legislation. Apparently her push to legislate her opinion succeeded somewhere, but I couldn't find out where and I'd really like to know.

While she has my sympathy for her loss, I think she's very wrong on this.

"Flagstaff's Dan Frazier sells a T-shirt that lists the names of soldiers killed in Iraq, and a Phoenix lawmaker wants to put a stop to it.

"PHOENIX -- A T-shirt sold by a Flagstaff man has provoked potential legislation to make it illegal to use a fallen soldier's name or photo for profit without the permission of their next of kin.

"On Frazier's Web site, the description of the shirt says it's "illegal in two states and could soon be illegal nationwide," a reference to similar laws already passed in Oklahoma and Louisiana. Texas has also introduced legislation, Flinn said."

9. So, it is not illegal to wear them?
The way I read that,
It is illegal for the company manufacturing them and the company selling them to make a profit on the sale of the shirt.
They can contribute the proceeds of the sales to any charity and continue to sell them, right?

10. TOuchy issue.
I am sorry for the families of the fallen. In terms, do I have the right to wear it. Free Speech. I think so. It's public record as the first entry implied. I also think, my free speech rights does not dishonor the dead soldier. Would I respect the families and due to their being gullible rw's; I'd not intentionally wear it in their presence. Would I wear it to an anti war rally, yes.
Had the dead soldier's known of Cheney's cherry picking evidence to get them to enter a war based on lies; maybe, they would not have enlisted.

14. now you got me to go back and reread that article a couple more times
"But Sen. Robert Blendu, a Litchfield Park Republican, said he would like to see the bill broadened to include those who use the names regardless of whether they make money.

"I just find no reason why a movie star should be protected under the law and not a soldier," he said."

sounds like they want to go after all those made-for-tv docudrama actors, writers, producers, directors.

yes, apparently it is illegal for this guy to make the shirts and sell them--not for you to buy and wear them. i guess he could donate the money (after subtracting out the cost of producing the shirt) to a nice anti-war nonprofit agency.

21. Ah - but what if it's not being sold for profit?
What if it were a non-profit group selling the shirts, and giving the proceeds to charity? Would that be a loophole?

22. what if it was a fundie, pro-war group and it was a picture of Casey Sheehan
I'm torn about this. I am a strong proponent of First Amendment rights, but I also believe that there is a right of privacy and that I should be able to control the exploitation of my name/image by others without my permission.

24. False advertising
It is illegal to make a profit from selling anything with the names of dead soldiers, not illegal to wear the shirts.
