Justices uphold welfare home searches

The Supreme Court rejected a challenge today to San Diego County's practice of routinely searching welfare applicants' homes without warrants and ruling out assistance for those who refuse to let them in.



In dissent, however, Judge Raymond Fisher said it was unlawful for an investigator from the district attorney's office to go "walking through the applicant's home in search of physical evidence of ineligibility that could lead to criminal prosecution either for welfare fraud or other crimes unrelated to the welfare application."


Why should I care?
I'm not poor any more.
I'm not on public assistance.

why do they have to still stalk them. I'd think the county workers should loose their jobs if they can't do them correctly.

FYI ..Just imagine if you are a guy on section 8,One kind of 'disqualification' ' is if they find womens underwear in your dresser drawer. With opposite sex undies these pigs ASSUME you are sharing housing and in a greed driven system where the biggest thieves where white collars sharing is verboten..And that in some states is 'grounds to be barred from section 8.

My heart goes out to the section 8 guy who is a cross dresser or trans-woman who may not be open about it yet.He will be forced to either admit his gender issues or lose his home..Snnaaaarllllll...

14. This is not new at all
In-home "visits" have always been part of applying for welfare. They don't usually do it, but it's always been part of the paper work that they could. People give them the right to search when they sign up.

15. Having known many people on welfare I can tell you this is different.
At least different from NC.

If you live in subsidized housing, in NC you are given at least a weeks notice prior to a visit, and they don't "search" your dwelling.

They check to see if all the codes are met and no repairs need to be made (lights work, doors work, no dripping faucets). But never, ever have I known them to search anything or check for: absent parents or extra people living there.

That's no different than people who rent regularly. They have to give access to the super for repairs. It's usually part of any rental agreement.

The only thing I've know people in subsidised housing to hide is pets. If you don't pay a pet fee, you can't have them in the apt. (just like regular apartment renters) I've sat many a pet for folks on housing subsidies. Nobody made extra efforts to hide the food or food bowl, they were merely put in cabinets.

The San Diego district attorney adopted a policy in 1997 under which applicants for welfare benefits must agree to a "walk through" of their residence while they are present. The inspectors check on whether the applicant has an eligible dependent child and has the amount of assets claimed. They also check on whether a supposedly "absent" parent lives at the residence. If residents refuse to permit a home visit, they can lose their benefits.


If you are applying or getting disability or food stamps or even WIC (nutrition for women, infants, children), there is a caseworker you visit. They DO NOT come to your house before, during or after. They just don't. Even if you've got kids.

That is where the problem lies. They are coming in to "check you out", even before you are given any benefits, to see if you are going to try to defraud them. That's why it's an illegal search. There is a presumption of guilt and a presumption of evidence of guilt.
