Breaking News - Ohio Voter Registration Lawsuit Back Already!
The US Supreme Court ruled today in favor of Sec of State Jennifer Brunner, because the GOP had no legal standing for the lawsuit. It is now back to the Ohio Supreme Court field by an individual from New Albany, which is a suburb of Columbus. (A rich Republican suburb I might ad.) COLUMBUS, Ohio -- A writ of mandamus was filed with the Ohio Supreme Court late Friday afternoon, seeking to compel Secretary of State Jennifer Brunner to match new voter registrations with information from the Ohio Bureau of Motor Vehicles.
T
he action, filed by David Mahal, is significant following Friday's U.S. Supreme Court opinion. In the opinion, the justices overturned a federal appeals court ruling that ordered Brunner to help counties verify voter eligibility. Their reasoning was that the Ohio GOP was a private entity and could not bring such action. Conversely Myhal, of New Albany, is a registered voter in Franklin County.

5. How does THAT grant HIM standing either?
It seems to me that the only person with standing would have to be an affected candidate.

There has to be harm or the potential to the person "with standing" doesn't there?

(Not a lawyer but I did stay in a Holiday Inn Express last night)

.. this lawsuit was submitted by an individual. If you are correct, maybe it will be dumped as well.

It looks to me like we will be having a repeat of 2004, here in Columbus, Ohio.

I can remember protesting at the Re-pug Sec of State (Blackwell's) office and nearly being arrested. I will do it again if necessary, in front of the State House this time.

the Indiana case, I believe it was. Didn't they say that voters could be required by the state to show ID because no one has proven yet that anyone had been disenfranchised by having to show an ID? That they couldn't really entertain the case until someone had proven they've been harmed?

I would think that this precedence would apply here. How is this guy personally disenfranchised because the Secretary of State will not run the voter registrations, that have already been verified, against a database that was not designed for this purpose?

Someone could just as easily file a counter suit and likely have more standing because they can claimed that they will be harmed. Especially if they know that they have a middle initial on their license, but put their full middle name on the voter registration card.

I don't think this will go anywhere because this is the court that set the precedence.

16. The U.S. Supreme Court set the precedence

ruling on the Indiana State law.

This case will go to the Ohio Supreme Court and either get shot down or they will rule in favor of the plaintive. If they rule in favor of the plaintive, the Secretary of State will take it to the U.S. circuit court and even up to the the U.S. Supreme Court if need be. The USSC has already set precedence and will likely throw it out.

The Ohio Supreme Court and the U.S. Circuit Court can also use U.S. Supreme Court precedence and likely will. They are not going to waste time and money if they know it will be overrule anyway.

The Ohio Supreme Court can not and will not give a ruling
that conflicts w/ a precedent set by the US Supreme Court ...
unless they think that a case can be made based on Constitutional
law.

The Court ruled that Ohio GOP had no rights in this case .... betya
that means the Franklin County GOP too.
