http://www.latimes.com/news/politics/la-na-scotus18-2008oct18,0,3579254.story

"The high court, in a brief and unanimous opinion, said the federal law that called for computer checks of new voters did not authorize private lawsuits to enforce it."

:woohoo: :woohoo:

1. Because they were overturning a ridiculously illegal decision
Maybe they're feeling they couldn't get away with it again, since most of them were there when Bush v Gore was decide.

2. because it was on a standing to bring suit issue, not the merits
Consistent with their rw leanings, guys like alito, roberts, scalia generally don't hesitate to close the door to the courts. Sometimes it stops conservatives, like it did this time; but most of the time, it stops those with leigitimate beefs from getting their day in court.

I'm glad for the result, but I wonder if its just temprorary.

4. Warning: the decision was based only on the standing of the Ohio GOP
to bring the lawsuit. There was no ruling on the merits of the case. The new law suit filed yesterday by an Ohio voter could produce an entirely different result. It is not over.

5. But Jennifer Brunner will keep fighting.
She probably anticipated this...all the way up to the election. But if they keep getting stopped, eventually their time will run out.
